Hi all, my question is.. My wife will have 3 years of being in the US married to me in Febuary 28 and ready for US citizenship. Can we send her N 400 packet before her anniverary or do we wait till 2/28 to send it?

She can file the N400 90 days before her 3 yr anniversary on the greencard and since she is filing under married to a USC, she has to be married for 3 years as well.

Was her Green Card issued before 2007/05/29? In that case (only) you can send in the N-400 prior to 2010/02/28. Otherwise, the earliest that you can send it in (or more accurately, earliest that USCIS should receive it) is 90 days prior to the 3-years-anniversary of her getting the GC.

No she got her green card on 2/28/08 so I guess we can send her packet now, right? It will be 3 years in Feb/2011..

Assuming you meet the other requirements, you can apply for naturalization on the later of:

90 days prior to the 3rd anniversary of the "Resident Since" date on your GC;

or

Your 3rd wedding anniversary.

Historically, this has not been a meaningful distinction for K-1 entrants, as since the GC virtually always took longer than 90 days after the marriage to arrive, the two conditions would be satisfied simultaneously. But for those of us who got our GCs within 90 days of marriage (and there are more and more of us all the time), we will have to wait until after our third wedding anniversaries to apply.
