I was living over seas with my husband for 2 years and found it very difficult, I came back to the states, got a job and applied for his visa, he went for the interview and they told him I need a co-sponsor even though my current income meets the guidelines. My question is this.. Do I have to wait until I work a full year (2011) and do my income tax before he will even be eligible to apply again? and if I wait, do I have to pay all of the fees and do the whole process over again? and if I do the whole process over again do I really have to wait until 2012 to see my husband? I don't understand why they are intent on keeping us apart when quite obviously we want to be together. I would rather live forever in hell than to be alone without him for 1 more day. Where can I find a co-sponsor to help me with this problem? :help:

First, they don't intend on keeping you apart. They have a job to do, which is to determine whether he qualifies for the visa. One part of that job is to make a fairly subjective decision about whether he is likely to become a public charge, if they let him come here. They take their job seriously and many US taxpayers thank them for doing so.

Your option now is to find a joint sponsor and have them complete an I-864 and provide the needed supporting documentation, so you husband can get those papers to to the Immigrant Visa Unit and get his visa. Otherwise, you wait until you file a tax return with qualifying income. You'll have an opportunity to do that about 40 days from now.

You should not have to work a full year to be able to sponsor... How long have you been in your current job, and how much above the poverty guidelines is it? What did you provide as proof of your current and sustainable income? Do you have any assets (savings, shares, property etc) you could use?

Any LPR or USC living in the USA can be a co-sponsor; ask family and friends first, but if they refuse or don'y make enough, cast your net wider- co-workers, people at church/ mosque, neighbours, remote family etc...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Actually my opportunity will not come until the end of the 2011 tax year. I was living overseas with him for the past couple of years and only came here in September. That means I will have to work the full of 2011 and file taxes in 2012 and then reapply and go through the process again and maybe hope that he once again gets the approval of the I-130 and so on....... I do not think that someone with current income to support their spouse should have to go by past income to help support him for the future. I am a citizen of the USA and I have a job so if they are aware of me being overseas, why do they need paperwork for the past? I think that is where it gets confusing, not all of us have rich family members that can help us out and that is not fair. If I had a ton of money then he would already be here, I hope you understand the frustration of the situation. being poor and being apart, then paying and reapplying... who gets the benefits of all of this? It is certainly not the family that is struggling to be together.

I have been at my job since september, I sent all of my check stubs and bank account information and at my income I make above the limit and stand at 22,600 for the two of us, they only had an issue with the 2009 income which was when I was living abroad. I really thought that with my current income he would pass and be able to come here but for some reason they want the co-sponsor. I did go to my parents, cousins family and friends but they were not at the proper level of income in 2009 and the one person that was unfortunately had already sponsored 2 people and it would have pushed her over the edge. I was thinking about going to my local mosque for help but thought that might be just a little too desperate although I am not sure, I would however do anything to find the help I need, it just feels so close and yet so far out of reach for me to get him here.

Why would you need a co-sponsor if you meet the required income guidelines?

That is exactly what my question is, I make enough but the past was not enough to satify them, I do not know what to do, If I had a co-sponsor I never would have left Tunisia to get a job and come here in the first place. The whole reason for me leaving was to come and get a job that would allow me to support my husband.

Life is full of IF's and you have just hit a huge bump. You have to regroup and figure out your next best step forward. You got to spend 2 years abroad which many don't have the ability to do. Many of us have to wait through the process here. We pay one way you pay another. If you had stayed there with no co sponsor you wouldn't have gotten a visa. The only route that might have worked better would have been a DCF but that is now water under the bridge. In the refusal papers do they give you the option of showing a cosponsor or more proof of income or is it just on it's way back to the US ?

This will not be over quickly. You will not enjoy this.

we have the same situation with the joint sponsor now we are stuck at NVC with no co sponsor for 2 months now after waiting 6 months for the approval we can not find a co sponsor we asked churches mosques we tried everything and nothing

Life is full of IF's and you have just hit a huge bump. You have to regroup and figure out your next best step forward. You got to spend 2 years abroad which many don't have the ability to do. Many of us have to wait through the process here. We pay one way you pay another. If you had stayed there with no co sponsor you wouldn't have gotten a visa. The only route that might have worked better would have been a DCF but that is now water under the bridge. In the refusal papers do they give you the option of showing a cosponsor or more proof of income or is it just on it's way back to the US ?

They did give us a chance to come up with a co-sponsor but if I had one I would have used them in the first place. I know that my situation is not unique but I also know that it feels unique only to him and I. I wish for, pray for and would do anything to find this co-sponsor and all I can say is that we will gladly become a co-sponsor when all is said and done so we can help one person not have to feel the pain of separation that we are now feeling. I make enough now but for some reason they want that past history and we just don't have it, all I can say is life is easier for me here but I would gladly go back if that is my only other option, I would rather live a hard life there together than an easier life here alone without him.

I would gladly come back to this site and co-sponsor anyone in the future that needs the help, it is a desperate feeling being away from a loved one but I will do all that is in my power even though at this moment I feel powerless, I hope you find someone soon or you may be just like me, working and trying to get that sponsorship on my own, I have never asked for help before and feel almost embarrassed...... well, let's face it, I am embarrassed to ask for help but I do it and try to keep my chin up, Allah has helped us through rough times and you never know, a miracle may be waiting just where we least expect it! I will pray that you find your co-sponsor and in the mean time prayers for us would be greatly appreciated too! :)

regrouping is the hardest part, I feel powerless but I keep forging forward, we met and married for a reason and that is because we love each other so with that love we will move mountains I feel it!

thank you sadandlonely and i hope someone will help you i know how hard it is

we made many topics on here but nothing everybody just put us down and i had someone who said they can help us but when we got online with them they ask for $5000 to do it can you imagine even if we have the money we won't do it if someone want to help they won't ask for money

and right now we don't know how we gonna make it

we made many topics on here but nothing everybody just put us down and i had someone who said they can help us but when we got online with them they ask for $5000 to do it can you imagine even if we have the money we won't do it if someone want to help they won't ask for money

and right now we don't know how we gonna make it

Right now my advantage is that I work for an immigration lawyer that is hard at work trying to find an answer, I promise you that when I find a solution I will share it with you, I know the feeling and desperation that comes with being apart but I also know that we are strong and we will go forward one way or another! I never give up hope and I have the ability to move mountains if necessary, I will find a solution and share my solution with everyone to make life seem that much sweeter. Never ever pay for assistance that will only leave you broke and with no help!
