Hi,

I'm pretty sure I know this would be a bad idea - but I wanted to get an idea from the visa journey community! I got married on Nov 14th, and 5 weeks later I still don't have my marriage license. I called the Allegheny county office, and they said it might not be there for another 2 weeks - which I think is ridiculous. I'm wanting to file ASAP - but I know that with my green card application I'll get an RFE without the license. Can I still apply for an EAD and advanced parole to travel - and then when I get my marriage licencse send in a copy right away? Or do I wait and send it all together?

Thanks for the advice?

You have to wait for marriage certificate.. They WILL RFE for it, and any associated applications (AP and EAD) tend to get placed on hold.

You can file for EAD prior to filing AOS, however, it WILL cost EXTRA ($380), and probably will not be approved BEFORE your I-94 expires, EAD based on K-1 expires when I-94 expires. EAD based on a pending I-485 (AOS) is a two year EAD, and costs nothing when filed for with or after filing I-485 (with copy of I-485 NOA1 letter)

AP needs to be filed with AOS or after AOS (With copy of I-485 NOA1 letter)

Better to have the wait be on your end - getting an RFE just delays things and probably puts you in the bottom of their proverbial work pile. No matter where the wait is - you're not getting your EAD/AP any quicker...right?

Without the marriage license - you can't prove you ever got married and validated the terms of your K1

Yes, rather wait the 2 weeks for the license, than god knows how many weeks for the RFE... :bonk:
