Hello everybody!

A little background information: I am a 24 yr old US citizen, and have a 26 yr old Argentinean fiancee. We are currently in Argentina living together, but have recently decided to move back to the US, and have put through our K-1 visa.

I have been living here for the past two years, and in this time, I have not declared any income inside the US. Therefore, I cannot be his I-134 sponsor. I have a close friend who qualifies, and is willing to sign the paper and provide the supporting documents, but I have heard that non-relative sponsors are not given as much weight. For various complicated reasons, I do not have a relative that I can ask to sign the sponsor form for me.

Has anyone here used a non-relative co-sponsor? How did it result? Any advice?

Thanks and good luck on your visa journey!!

This would be relevant only to the US consulate in Argentina. Anyone's experience with any other consulate in the world would be of no value to you. Consulates differ dramatically in what they will accept regarding co-sponsors for K visas. Some consulates will accept any warm body with a birth certificate or passport and a tax return. Some consulates wouldn't accept Warren Buffet, even if he was your father.

You should check in the regional forum for Latin America.

As Jim stated the consulates vary regarding accepting joint sponsors for a K1 petition. Verify what you've heard with the US Embassy or others that have recently gone through Buenos Aries for a K1 visa.

Past income is not as important as current and ongoing income. Are you planning to be employed prior to you and your fiance entering the US? That may change how your joint sponsor is viewed. If you demonstrate a current and ongoing income that is close to the required amount then a joint sponsor may be "more acceptable."

Generally any US ciizen or LPR can be a sponsor.

Off topic (a bit): Have you been filing US tax returns while earning an income in Argentina? Not having an income inside the US does not mean that you are not required to file a US tax return. This will need to be addressed later in the process when you would adjust status for your then spouse and file the I-864 affidavit of support.

I know that it varies region to region, but I was hoping to just get a general idea!

I have been filing tax returns, even without income, so at least there I am not worried. The other comment you made about current ongoing income confused me a little. I am currently working, just not making enough money for the 100% of the poverty line. I will not be changing jobs prior to my fiencee's interview. My friend is making way over the poverty line, and will also not be changing jobs.

Is this what you meant?

Thanks so much!

Will your income continue in the US? If so, then it can be considered.

Also, it is typically 125% of the poverty level for K1 as it is a non-immigrant visa with immigrant intent.

US Embassy and Consulate Discussion

This is the place to post your experiences or questions related to this last step before moving to the US. Topics relating to I-134's, packets sent from consulate and medical & police certificates should be posted here

YMMV
