Currently the poverty line for a household of two is $18,212. My current income from my 2009 Income tax return/W2 amounted to $25,000 which makes me above the 125% poverty line. But recently I've been told that this might not satisfy the immigration officer who will review my form. Is this true? I do not have any other assets to present and no other household member in my apartment. My wife is here with me in the US, hence we are applying for the 130, 485, 765 etc. My wife does have family here but I'm not sure if I can use them as a joint sponsor.. I am hoping to submit our application within this week. Thanks in advance!

You don't quote a source for the statements which are causing your concern...

Is this your wife's second cousin's roomate's sister's best friend had trouble with their case or do you have more direct evidence that you should be concerned?

The I-864p establishes minimum annual income required. If they actually want more than this, then they should say so. It's not like you are barely over by just $1. You're over by more than 30%. It's true that the IOs have some discretion. Is there reason to think that an IO might doubt your ability to maintain an income above the poverty line?

Thanks for the reply. One cause for concern was I got laid off work on January but started with a new company on Feb. Based on my latest pay stub I am about 30% above the line..

Our source is my buddy's dad who used to work for USCIS. Probably I've just been over analyzing stuff..
