Hi all,

Im very confused a to what are the next steps to do a follow to jon for my husband 4 year old son. I called the uscis and was told we had to do a I-130 and that we couldnt do a follow to join for his son. I exlpained that his son is on the approved I-129F and that it hasnt been a year so why cant we do the follow to join. Th guy sad we cant do it because my husband is now a green card holder and we need to file the I-130 instead. Please help me understand what do we do next to get him here. Thank you be blessed

You can file a I-130 under a stepmother-stepson relationship. The boy will come on a CR2 status (green card holder), no need to adjust status anymore.

The day i asked for help from you guys i also emailed the embassy asking them the same question. Well i recieved an email respose from the embassy the other day. They gave my stepson an interview for december 7th. I have two questions please. 1. Can my husband fly down to be with him for the interview since he is 4 years old? 2. If we dont do the I-130 will that cause a delay or a problem? They emailed the same package that they sent my husband when he got his interview there. Thank you and sorry for double post wasnt sure where to post to get help.
