Hi guys! I'm so confused right now. :help: Any feedback from you guys will help. I am going to file for I-130 for my mom and dad who live in the Philippines. First question, should I, being the petitioner, also be the one to sign/file the Affidavit of Support, in the other words, be the sponsor? I am getting laid off in November but I have all the needed documentations to attach to the AOS. I have IRS transcripts for the the past 3 years - 2007 to 2009 and I'm still employed at the moment, only, my employment is going to end next month. Should I wait till I find another job? If I do find another job, is there a required length of employment before I can file for AOS? Or can I do it as soon as I get permanent? IF it doesn't require for the petitioner to also be the sponsor, can my husband be the sponsor instead? :unsure:

By the way, I haven't filed for I-130. I worry that if I do file right now, I might have problems with I-864(AOS) in the future given my employment situation. Does anybody know if Unemployment Insurance benefits count as "Income"?

File now, it will take quite some time to process applications. By then you may have a new job, as of now if your income is sufficient to qualify for approval that is all you need to worry about now. Also keep in mind your and your parents can use assets as well if by the time the interview comes they request updated I864.

Thanks for the suggestion! I really want to file ASAP. I'm just worried about getting laid off and how it will affect AOS. By the way, do you know if somebody else, like my husband, can be the sponsor instead of me?

you're the sponsor, but your husband can be your co-sponsor if you don't make enough.

for now, you only need to file the i130 for each of them.

You would be able to use your husband's income as well.

But the I-130 won't be approved for quite a while, so it's not really something to worry about right now anyway.

Thanks Joanna. Maybe I just worry too much. That's what I will do, I will file the I-130 first.. and hopefully I will find another job soon. =)
