Hi everyone. We have hired an attorney to work on our application which he filed on 3rd Mar and our interview date is already fixed. But we are not satisfied with his performance and intend to fire him. We affraid if he can cause any problem in the process! Do you think he can influence the final decision? Have you heard of such experience?

I doubt it. You would have to notify the the embassy/consulate where the interview is taking place to have him removed as attorney of record.

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Are you worried that he will try and sabotage things? He would have to be extremely unprofessional to do this and probably could get into big trouble with the bar, not to mention that you would probably have evidence at the interview.

We fired our lawyer, we were cordial about it, simply stated that they were no longer needed for the duration of the process, thanked her very much for her time and effort and moved on.

it was easy and painless

So glad that I checked here before hiring a lawyer. I almost made that mistake of hiring one since my case was straight forward..nothing to hide or cover.

Why do you think your lawyer would put his/her reputation, licensing and career at stake for the small fee he/she collected or is owed by you?

Your attorney won't have any say in the interview. They're not even allowed to attend. The only thing that anyone could do to sabotage you would be to try to claim you were committing visa fraud, which an attorney isn't going to do, because as others pointed out, they'd be risking their reputation and career over one client who, in the long run, won't mean much to them.

If you feel that the attorney isn't living up to your expectations, fire them. Their portion of the K1 is over, and you can do the AOS on your own if you feel comfortable with it. I doubt you'll get any money back, because you signed a contract for their services and will still owe them for services rendered up to this point.

We were going to hire a lawyer too but they were so expensive and we would have had to mail all forms back and forth with signature. I would reccommend people not to hire one!

but i don't think they would be bothered to sabotage your case.

October 8th- Sent off K-1 visa package

October 21st- Received email saying we have been assigned to CSC

October 28th- Waiting on NOA1

October 29th- NOA1 received!!!

March 16th 2011- Received email saying petition for fiance has been approved and that NOA2 is in the mail!

April 12th 2011- Waiting on lettter with interview date from Dublin Embassy. Medical scheduled for 26th April

I was going to hire an atty but elected to just seek advise from him. I prepared everything and met with him for 1/2 hour... I did not pay the retainer fee just his hourly fee.

Firing a lawyer is probably one the most enjoyable things I have ever done! I pay my bill, ask for my file and tell them that they are no longer needed. Afterward, I come home and have a big party with my friends and neighbors and I get sloppy drunk for a few days!!! Nothing feels better than to rid a leech from your life.

Its kind of like getting a second opinion from another Dr. and going back to the first one to fire him and also getting your last script.... and he is so upset about losing you he prescribes something that causes you to become very very sick.... It just isn't going to happen unless he is already going to prison and just is really really nasty.

Generally no.

If your case is fraudulent ands he knows it, then the answer is YES. Of course he would be complicit in a fraud (can you imagine an attorney doing that?) but hew could have someone else call on you.

I doubt it, Why? He already has your money and that is what he wanted (Oh, in case you didn't know, you will NOT be getting a refund) He really just doesn't care. You already know that, which is why you want to fire him. He will barely notice. I do not think that his secretary will call him on the golf course and tell him that you fired him. Betcha.

Just make sure you get a COPY of everything and notify USCIS that he is no longer your repesentative so they will not mail things to him.

Immigration attorneys can be assumed to be unprofessional. But as you and Payixbka point out he is not going to risk his future fleecing of K-1 applicants to hurt this one, particualrly since he already got his money. Non issue really.
