Hi

I just filed i130 for my wife and I received the I797C notice of action which has the case type and receipt number.

But also below the receipt number it has a priority date of aug 19th 2010, which is also the date the I-130 was received by the uscis

I submitted a letter of expedition with her I130 and am just wondering if that was approved that's why this letter has a priority date?

Can someone please help me?

I'm very excited and confused by this at the same time.

a 'priority date' for an I-130 filed by a US Citizen for a foreign spouse,

is usually either

--same date as USCIS Receipt Notice Date or

--several days prior.

I-130s filed by US Citizen for foreign spouse have 'immediate priority date' - no waiting required, for any priority date to 'become current'.

So that mean what again? ?

All I'm trying to figure out is if my request for expedite haas been approved.

If your expedite falls USCIS "expedite criteria", yes they will. Otherwise, they will simply deny the expedite.

you'll need to call in to USCIS, about 3 weeks after the 'receipt notice' date, and inquire for that 'expedite status'.

they usually will only expedite a case for humanitarian or emergency reasons.

like if you need their kidney right now or you will die, or something....

hi !

if you included an expedite request in seperate letter, included in the I-130 packet

and IF

you wrote 'expedite' in red letters on the outside of the envelope

then

you'll know something 3 weeks later, by calling the USCIS hotline # .

it takes about 3 weeks for yer casefile to get out of the mailroom and into the proper queue.

IF it made it into the EXPEDITE QUEUE, you'll know, from that phone call.

So, mark yer calendar, with the 'receipt notice' date, go forward 3 weeks in time, mark it again for 'calling USCIS day'.

I know in the past, one person in India expedited their I-130 approval for his beneficiary depicting the violence in that area. He took cut out pieces from the newspaper and submitted to USCIS.

Yes I did

I took news papers articles from ny times, local and other places.

My reason were violence in karachi, kidnapping of foreigners and their families and the flood and I included all sorts of things like warning from state department and newspaper articles........I'm keeping my fingers crossed!

Priority Date has more meaning for other family petitions. Spousal petitions have no cap and are effective immediately. For other family members, the priority date would determine the wait time to be eligible for a visa.

Good Luck ! The waiting is hard. I know from my own experience. Hang in there and be patient. My advice is to use Skype or some other social media to stay in touch with the spouse. Keep your spouse informed about any changes in your petition and status but do not set unrealistic dates for things to occur. I was disappointed many times because of this. One bit of advice I would offer is that if your petition is approved for expeditious handling you should remember to send all requested documents addressed to the appropriate supervisor. I made the mistake of receiving expedited handling but didn't send all the documents to the supervisor's attention. This resulted in a long delay in handling. Good Luck !
