Timeline

My husband makes 16 k in salary and gets 6k in VA disability and that adds up to 22k .We got an RFE because we didnt send proof of current income so now we're sending proof of current income like pay stubs and employer letter assuming that they would accept 6k of VA disability compensation.

My concern is that since I came here on a F1 visa (that expired in June 2010) if suppose USCIS doesn't accept my proof of current income like pay stubs and letter from employer and denies my application ,what options do i have ?

1) Live here without any status for some time and try to find a co-sponsor ?

2) Move to his mom's house for 2-3 months so that she could be a household sponsor and then file a new AOS(assuming they wouldn't put me in removal proceedings by that time)

3)Go back to Moscow and apply for a CR1( I don't have any idea what that is)

4) What would be the best strategy knowing we don't have a co-sponsor right now ?

5) Would i incur any ban if i go back to Moscow and start all over ?

They RFE'd us because we forgot to send pay stubs,employer letter or they just don't accept combination of incomes.?

We sent them IRS transcript for 2009 and VA letter stating disability compensation while initial submittal.Now this time we're sending pay stubs for last 6 months,letter from employer and bank statements for last 12 months to show direct deposit of VA disability compensation.

I'd have to send bank statements to show direct deposit of VA disability compensation but I don't have a lot of balance left on my bank statements.Would it cause some problem ?

If suppose ,they won't accept combination of incomes,would they RFE us one more time or they would just deny us ? We don't have money for a lawyer,Plz kindly help us...Thanks in advance...

This is the BEST RFE example if one doesn't send employment letter or paystubs to prove the current income.

Nir12, I don't think your bank balance matters as long as you provide all the documents requested in RFE. Based on your total income, you are qualified I-864 candidate. Nothing to worry, just respond to the RFE.

This is the BEST RFE example if one doesn't send employment letter or paystubs to prove the current income.

Nir12, I don't think your bank balance matters as long as you provide all the documents requested in RFE. Based on your total income, you are qualified I-864 candidate. Nothing to worry, just respond to the RFE.

On the attachment sheet for item number 23 of I-864 ,for the months of august,sep,oct , nov, and dec,I would have to multiply number of hours worked with hourly wages,add it and then add this amount to the total earnings and VA disability compensation ?Anything else i need to send ? Thanks again...

Nir2, You should ALWAYS focus on Total income (before tax income) in I-864 which is the basis of the poverty check.

The below are the quotes from I-864.

"You may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income,or income from any other source, you may also include evidence of that income."

Since you are sending those, you are all set. And I am confident that you are perfect now.

Nir2, You should ALWAYS focus on Total income (before tax income) in I-864 which is the basis of the poverty check.

The below are the quotes from I-864.

"You may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income,or income from any other source, you may also include evidence of that income."

Since you are sending those, you are all set. And I am confident that you are perfect now.
