Hello,

I am applying for my adjustment of status to that of a permanent resident based on my marriage to my wife who s a US citizen. I need a small help in filling out the I-485 form. In part 2 section A of the form there is a question which says were you investgated by an immigration officer ?? I want to know the reply to this. ( I entered US on a F-1 visa). Also in part 2 section C it asks for any affiliation with any organisation. Do I have to provide my employment history in that ?? Since we are not able to hire an attorney this help would be greatly appreciated . Thanks in advance

Were you inspected by immigration officer?

Assuming you came in legally, e.g. at one of the airports or checkpoints, then ABSOLUTELY YES.

Only people who entered illegally (e.g. sneaked across the border) would say no.

Organizations:

I just listed clubs that I was in, e.g. church groups, social groups. Employment history will be covered in other parts.

Thanks a lot for that. As I said earlier we cannot afford to hire a lawyer so I want to ask a few more questions here.

1.) Is there a chance that our application will be rejected since we do not have a lawyer ?

2.) For bonafide marriage proof do we need to send pictures of our marriage too or do we just need them at the interview ?

3.) Also for the affidavit of support, can the parents of my wife be our sponsors ?

1) There is a chance that you application could be rejected with a lawyer... a lawyer does not necessarily increase your chances of success

2) initial application you submit the marriage certificate... if they interview they will tell you what else they want to see

3) a sponsor needs to be a qualified person... if your wife's parents qualify, they can submit a affidavit

1-no...a lot of people have done this alone

2-at the interview stage

3-your wife would be your sponsor, her parent/parents would be co-sponsors

Above information in regards to the bonafide marriage isnt necessarily correct...

The OPs status says F-1 of which it would be advised to present more than a mere marriage certificate with the AOS packet. I too did AOS from a F-1 visa and unlike a K-1, we had no intention of gettin married before we entered the country, and therefore would need to show proof of our relationships (k-1s already did this to enter the US).

You might include this info in the "AOS packet" but it is not because of the I-485, but the I-130 which is required to determine that the alien is an immediate relative of the USC..

1. Assuming your case is uncomplicated (e.g. no illegal doings anywhere), then having a lawyer is completely pointless. It is a waste of time and money.

2. I included our joint bank account statement, rental agreement, joint auto insurance. Documents are important, not photos.

3. Others have answered this for you.

I strongly recommend the book "Fiance & Marriage Visas: A Couple's Guide to Immigration". You can get it on Amazon and it will be the best $26 you ever spend in your life. It will tell you EXACTLY what to fill in each blank on every form. In addition, carefully read the USCIS instructions given for each form, which can be downloaded from their website. Those two combined will give you all the answers to your questions.

Alright thanks a lot everyone for your assistance. I just have a last question before I mail my application packet on monday.

1.) Do we need to submit actual marriage certificates or just the copies.

2.) As a proof of bonafide marriage can I include cellphone records of text messages and calls made to my wife for the past 6 months before our marriage ??

1. Copy is fine. You will bring the original to the interview.

2. I think what USCIS considers proofs are signs of commingling of finances. Pictures and text messages shows a relationship, but are easy to forge. This is why you see so many people using bills that have both their name or joint checking accounts or house/car titles made out in both names.

Also I have a few more questions regarding form I-485:

1.) In the section where you list the name of organizations you were affiliated to, do I have to list of name of all universities which I attended in the US?

2.) I was on F-1 visa but my reinstatement was denied a month back by USCIS for lack of evidence. I am not in removal proceedings or anything though. So in the section which says your current USCIS status what should I mention ? My F-1 visa is still valid so should I put F-1 status ?

3.) Also in part 2, I am applying for adjustment of status because: I selected option h other basis of eligibility and printed that I am married to an US citizen. Is that ok ?

4.) I dont have a current job so in the current occupation column I printed NA. Is that ok ??

5.) In I-130, it asks for expiration date of i-94. I am on F-1 and dont have an expiration date listed. Should I list the expiration date on my I-20 form ??
