Timeline

According to the Monroe County i can formally in writing request to get married within the facility. Which will be mailed today...I am asking PLEASE someone pray for us. Also met with lawyer, and he states that the I-212 will come much later in the process. That once we are married that i am to file the I-130. My question to everyone is will i make matters worse if when this child is ready to be born, can i go to him in Belgium so he can be a part of Her/His life? Can i have my baby with him in Belgium? I want for him to see his child born... BUT what will that do when it comes to the baby? Will i have to fight for both to come home? Just a thought.. He should hold his child, kiss her, smell her... Thoughts?

If I was in your situation I would not think twice... I would travel and stay with my Husband, and I would not come back until my Husband could come with me.

Assuming you meet the residency requirements, your child will be a US citizen as well. You will file a CBRBA if you have the child in Belgium so the child can receive a US passport.

As for having the child in Belgium, I guess that is really up to Belgian immigration laws. Will they allow a pregnant woman into their country? What about insurance, how will you pay to have the child in Belgium?

And yes, the I-212 will come at the interview stage.

Your US health insurance is not going to cover the birth of a child abroad. Think about it. There are no "in network providers" in other countries.

As for having the baby in Belgium, that depends on a number of things. Would you be able, as a foreigner, to have your baby there under their health care scheme?

Here's the bottom line - you and Erwin need to decide where you want to live. Then take it from there. If you want to live in the US, you stay here and have the baby while his visa and any waiver process. If you want to live in Belgium, start researching their immigration system and requirements.

As for having the baby in Belgium, that depends on a number of things. Would you be able, as a foreigner, to have your baby there under their health care scheme?

Hey, some insurance policies do cover things abroad. You need to call them and find out what your coverage is, if you're considering this.

I would be able to keep my job... I would just complete my Maternity Leave there and come home. That is obviously 9 months from now... ( god willing) and so if i can visit before then, if we can't get married before he goes.. then the I130 hopefully will be filed and we will be in our lovely hurry to waiting period of that process. So at least by then we could be on to the interviews... speaking of that what about CR-1?

I am trying to research everyday. I haven't looked at the support level yet... truthfully.. don't know yet where to look. It is alot to take in at once, it comes at me in waves. There is so much!! There is alot behind this story that hasn't been mentioned. For instance... My oldest (cause i was to young) has his graduation party tomorrow. So i have been trying had to focus on everything. I have an 8 yr old that is my little guy...We all miss Erwin... He has been apart of our lives now for a year. It's like we had a taste of a family.... then just gone. Like something is missing now. Erwin was wonderful to be around... of course not all the time. We all have our moods. So i try to focus on one thing at a time, Kids first, then work, then this situation. I have to keep my job... without it none of this is possible. Erwin cooked, cleaned, we played games, laughed ... complained about my barking dog.. you know life. I wrote the letter to the Director of Immigration Customs Enforcement today.. I hope she shows some mercy.. We are Still all people.. He is not just a number / criminal ...maybe i can plead to that. Yes traveling would be hard with an infant... that to shall pass. Thank you for your reality check for me. If you have time.. or know where i can look for the support info that would be very helpful. I didn't know i just assumed that i make enough. Please keep in touch.. i need all the help i can get right now. I am sure it will get somewhat easier. ( fingers crossed) :help:

I understand how you feel :)

So if I understand correctly you have 2 kids and expect a third, correct?

That would make your household including you and Erwin : 5 persons.

For the affidavit of support your income has to be 125% of the poverty guidlines, so according to this site http://liheap.ncat.org/profiles/povertytables/FY2010/popstate.htm you need to make at least 32,238 $ a year and prove it.

I hope you'll hear good news soon :)
