Anyone born in India ? about your birth certificate

My husband's AOS was denied recently becuase his INDIAN birth certificate is in English, not Hindi or another local language. USCIS has declared it a "translation" but it's not... Does anyone else have an Indian birth certificate in English?

Eeee. I have a birth certificate completely in English issued by the Calcutta Municipal Corporation (those might be the only words that are also written in Bengali) that is now twenty-three years old, weathered and yellow and held together by tape. NVC accepted it without any issues.

My husband has his birth certificate that was issued by the New Delhi Municipal Court, it has a green border around it and some stamp on it.... Everything is in English and then under the English words Hindi is written... USCIS & NVC took it without any hiccups

I also have my Indian Birth certificate in English and when I did my AOS, they accepted it without any problems.

My husband doesn't have a birth certificate, so he got an Affidavit from his mother IN ENGLISH stating his birth info and they accepted that. However he does have a caste certificate which has English and Telugu right under it.

That is awful about them not accepting it! You got unlucky and got someone in a bad mood rejecting your application, which is totally and completely UNFAIR! I can suggest maybe getting an affidavit from your parents, stating the birth info is correct. Also you can write a statement about it being the original birth certificate, and such certificates are issued in India regularly, and get that notarized. Good luck!!

that is really bizarre, esp. for an AOS package (??? - its probably the DS-230 form since that's what you need the birth cert for). my wife's is in both languages (issued from Kerala), malayalam and english written side/side. NVC had no issues with it. I would call and talk to them. the suggestion of getting an affidavit is also a good one. affidavit from his mother is preferred over one from father. the DoS website does list parental affidavits as valid secondary sources of birth, if the primary is unavailable or not acceptable. as was mentioned above, those kinds of affidavits are obtained routinely in India, since birth certs were not routinely issued in the past.

My own (issued in 1965 by Madras Municipal Corp) is in English--albeit with much atrocious handwriting. It did cause me some problems once when I wanted to join Canadian Forces (name on BC not match to name on all ID including Citizenship Card and Passport), but was accepted easily at Montreal Consulate (in fact, when I mentioned it to the woman to whom I had to hand documents, she looked at me with a bored expression and stated "oh, we see lots of those").

Mine's in english too but since it did not have my name on it (parents had not named me yet), Isubmitted a copy of the cerificate and a notorised letter on a stamp paper from my mother stating what they needed as proof of birth. That was good enough for us.

Hi danielparul, can you tell me about getting the notarized letter ? whom did you approach for this..India or US? and stamp paper, i suppose u mean, its the indian one..

I had the letter typed on an Indian Rs. 20.00 stamp paper. My mother signed it in front of a lawyer who we knew and he put his stamp and signature on it.

This is how I worded it -

Affidavit by: (Mother’s Full Name, fully spelled out) regarding (Child’s Full Name

(fully spelled out)– if the child is married, the child’s maiden name should be indicated)

I, (Mother’s Full Name) hereby depose and say:

1. I reside at (Full Street Address and postal code);

2. My maiden name is (Mother’s maiden name, fully spelled out);

3. I am the mother of (Child’s Full Name) , who was born on (Date) in (City),

(State or Province), (Country);

4. The father of the child is (Father’s Full Name, fully spelled out); and we were married on (date)

5. This affidavit is being submitted because (there is no official record of birth

OR the official record of birth is incomplete concerning [Child's Full

Name].

I declare under penalty of perjury, that the foregoing is a true and correct statement.

Yea - even mine issued by Mumbai Muncipal Corporation is in English. I never had any proble with it.

I guess you can send it back saying India was British Colony and unfortunately all the documentation is done in English.

I know I would be mad if my BC was rejected coz its in English.....
