I -864 Urgent,,,,,Please Help.

I am married and adjusting my status with in the US .On the form I-864 item 23 we have to mention income.My point of concern is that my husband makes about $ 16,000 in income which is below the poverty line ,also he gets 6k a year in his VA disability .How could i add these two incomes on item 23 and also my husband doesn't file taxes for the VA disability so is he required to write an explanation for that ? Also, do we have to mention his adjusted gross income or gross income in the item 23 ? Please help .........Thanks a lot in advance ...........

IMO, on top of everything, the USC spouse will need to get a co-sponser/joint-sponser, as HIS income is not enough to qualify.

I confirmed about that here on the VJ and many people replied and confirmed that he can include his VA disability compensation as a form of an income that's why we are not going with a co-sponsor now again this is making me confused. Could he include his VA disability as an income and combine his salary and VA disability compensation in the item 23 ? and does he need to write an explanation why he doesn't pay taxes for the 6k he gets as VA disability compensation ?

Hi,

For item 23 it asks for annual income. This means ALL income, no matter where it comes from. You must attach proof of his VA disability payment. That combined with his income should suffice.

The answer to your question, regarding gross vs adjusted gross income, is on page 8 of the I-864 instructions. I personally think it is really important to read all of the instructions.

"For purposes of this affidavit, the line for gross (total) income on IRS Forms 1040 and 1040A will be considered when determining income. For persons filing IRS Form 1040 EZ,the line for adjusted gross income will be considered".

Thank you so much....Appreciate it.......Actually i was pretty confident about including VA compensation as an income until someone here on the VJ claimed it would not count as an income.I think this VA disability compensation thing is very tricky and it's really hard to determine whether it would be counted an an income or not.Anyone who has any real experiences ....All the suggestions will be highly appreciated........

I look at like this - my husband is receiving VA disability payments and this evidence was required when applying for a mortgage. If the government accepts it as a form of income for that purpose, then surely it's fine in this instance too. It should be easy to obtain a proof of income letter from VA as we needed one for the mortgage. It will list his current payment amount and how often it's paid, and when the payments began.

Also, your post implies that you are in the US on a visa other than a family visa and are now trying to adjust status from that visa. So...
