hello everyone,

i'm a beginner of this forum i'm italian and my girlfriend is US CITIZEN.

we are going to apply for k1 visa , and we'd like to kno all the process and documents to do that.

i can say that she have a 2 month older baby and we know each other from september 2009, but we are ready to get married cause i want to stay with her. our situation it's a little bit complicated but i hope somebody can help with advice.

Not sure what is complicated about your situation - from what you have posted is looks perfectly normal!

1. - read the K-1 finacee guide and get familiar with the forms and process.

2. step - Get engaged (does not have to be anything too formal but you wil want to pick an engagement date because you could very well be asked at some point (like the visa interview).

3. Start on the forms - (you can see the required forms in the guide section) There are a few forms that you (the beneficiary) will need to complete and send to your "fiancee" to be submitted with the petition.

4. Review review and review the petition package prior to the USC (your fiancee) sending it.

5. When everything has been checked - your finacee sends to the USCIS.

After you file you will receive NOA1 (letter confirming that your application has been received. The after about 3 months (more or less) you wil receive NOA2 (notice of approved petition - unless there are RFE that need to be addressed)

After the petition is approved it goes to the NVC (National Visa Center) and then to the consulate. The consulate in turn send a packet (letter) to the beneficiary with instructions on what forms to complete to apply for the visa and what things to start gathering for the interview.

After the consulate receives the required forms they will send a notice of interview appointment and further instructions for medical exam, interview appointment date, etc...

That is it in a nutshell.

As she is the USC, her child really has no affect on the process other than an additional family member to account for on the afadavit of support (which will be required later).

thanks for advice,

you know that the fact that i met her only since 2009 could be a problem.

i want to take care of the baby and i want to take care of her, we made also a trip together here in italy.

so i stay with her in USA and she stay with me in italy and probably she will come back here in italy on summer time so.

the problem could be if the baby is not mine? she is unmarried it's better that i sign the acknoledgement of paternity or just apply directly for k1? thank again

What is an acknowledgement of paternity? Just something stating you know it's not your child?

If it is anything to try and make YOU responsible as the father without making the birth father responsible don't do it! She didn't get herself pregnant (well...not likely...LOL), and the birth father needs to take care of his child as well! Hopefully, the child will be really lucky and have two great dads in her life :)

I GOT THE VISA.

i was not questioned at all, our reletionship is true and genuine, and the CO did not asked me any question about the baby, i said the truth and this was helpful, anyway we did everything alone, no lawer and we did everything in 95 days the visa is in my hand! bye

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Frabra, I have observed that the interviewing consul in Naples is very professional, generous, kind and cultured. I have been there twice and witnessed how he generously hands out visas. Unfortunately for me and all the others who possess previous passports he is hard to please. I have renewed 4 passports already and the latest is an amended one. I also have a 17 yo daughter named in the petition but he never asked her any question nor questioned her regarding her paternal status (figlia non riconosciuta).
