This may be the right time to get your representatives involved (congressman, senators) - what's enough is enough and it's been almost a year. Let the reps shake the USCIS a bit and get the things moving.

I mentioned that to him, so I hope he gives it a try. I'm just no so sure what they can do if it's just a matter of waiting for the background check, though..... It just sucks that his interview was delayed for more than 3 months because no one bothered to order his file! And it's confusing about the biometrics, too. First they said that he had to re-do the fingerprints because they were expired (on the day of his actual, re-scheduled interview), then he was told at an INFOpass appointment that his fingerprints from last summer were NOT expired and everything was ok - the file was just waiting for a supervisor to sign off on it. Then he gets this email saying his background hasn't been checked... is that the same things as the biometrics?

I'm just irritated and overwhelmed. It's not even JUST waiting this long - there are other things going on in our lives right now. Hell of a week....

For all we know, email doesn't have to mean anything - USCIS has been known for mistakes before.

To be honest, it does NOT take that long to run background checks on someone who has gone through AOS and ROC - it's just about updating them since the last time they checked it (ROC time). You can get the congressman involved, you're the USC and husband is potential voter for elective reps - they do want to help you, you just need to contact them. Get to the webpages of reps, sign the release form, send your cover page detailing the issue and any notices you received and then follow up with the immigration aide.

I agree. Poor guy had to wait until I finished finals so I could help him with the letter (he does a good job, but still likes for me to double check his English). We just finished it, so we can send it to go out first thing Monday morning.

I figured we'd be done by now. We should have been done months ago - his interview was originally scheduled almost 7 months ago.

This is a straightforward case. We're still together - very happy. He's never been in any trouble. Only left the country once; for less than 2 weeks. No RFE or anything like that. Not sure why this is turning out this way.

At least he got here quickly - that was the most important thing. We hated being apart.

Still nothing? Come on venus, take over and start bugging all your representatives about this - have you considered going down the writ of mandamus route? That ought to force them to get it done, you're past the 1 yr mark of sending the paperwork for naturalization in.

He finally got a call back today, but the lady just said it's in AP, and there's nothing we can do right now. She said they won't even tell her why it's stalled. She said that AP stops the clock. She said it could be something as simple as waiting for verification from some school he went to or something. Sounds like hooey to me. It's so annoying. She said all we can do is sit and wait for the process to start back up again. I don't understand - it's such a straightforward case. And he didn't have to sit in AP (or if he did, it was so fast, we didn't even know about it) for his visa, AOS, or ROC. If everything was cleared back for his ROC - not too long ago - I don't understand what the hold up is. I even called them when I got home and he told me about it. I was told the same things. Nothing anyone can do. No one knows anything - and by law, we can't be told. No way to know what is holding this up, or how long it's going to take.

I don't know anything about a write of mandamus. Can that help in this situation? How do we do that?

So where's the hold up - obviously someone messed up and they haven't caught it yet - no AP for ROC, AP for N400? Shouldn't go that way. Be nice but firm in pointing it out to your immigration aide and ask for results and then say you want to do writ of mandamus.
