I 864 dilemma

ok so another hopefully last I-864 dilemma is that my brother is my co-sponser. him/his wife filed joint tax return this year. should he write his total income in (1040 line 22 total income) 2009 which is alot more than his 2008 and 2007 (he wasn't married then)

i'm including his 2009 recent paystubs and w2's as well. '09, '08/'07 tax returns.

since tax return is like more than 70 pgs. what pgs should he include??

im' also including my 2007, '08 and '09 w2's, and also recent pay stubs.

copy of my 2007 tax return had less than $3000 (dependent under dad tax returns)

letter about y i didn't file taxes (wasn't making enough, wasn't liable to pay taxes or file tax return)

that's the only thing im submitting with my I-864.....anything else????

An individual sponsor with joint tax return states only their own individual income, not the joint total on line 22. The complete tax return with W2 forms etc. will document the income that belongs to the individual.

Question# 23, You need to write your total annual individual income which can be from W-2s. Line #25 asks you adjusted gross income which should be from your 1040 Tax forms, AGI.

This can be different from #23 because you can have any interest income added or you may have losses like rental property loss or stock loss which can substract from your income.

Hope that makese sense. And you include his tax returns(1040 form+ all schedules if they were completed).

You use the largest number on the W2 or from multiple W2 forms. Individual income will come from W2, 1099 or Schedule C in some cases. If only from one job, then only from one W2 form.

2009 income is found on line 1 of the W2 form. Current income is exactly that, current income. The individual states their current annual income and documents it with and employer letter and/or income. For example if they got a raise from $36,000 in 2009 to $38,000 in 2010, then they state $38,000 and document it. The April 30 pay stub for a person earning $38,000 should show a year to date income of $12,666. Your sponsor should be aware of their current annual income. Ask them.

The sponsor states their current income. Sounds like the sponsor already did. It is the sponsor signing the form. Go with what they stated as their current annual income. You are overthinking this. Or, would you prefer to call the sponsor a liar?

so i'm writing the amount from his W2 line 1 into Question #23.

i have yet to answer his AGI from 2009 Q #25 (he filed joint return)
