Is the baby the child of the USC petitioner? If so, file for a Consular Report of Birth Abroad. This will allow the child to be a US citizen through the USC parent.

I think the baby is from LPR parents, that's why I said another I-130.

The OP is the non-USC spouse. His wife is a USC, however, reading back through his posts - the wife hasn't lived in the US after her birth, so the babe isn't eligible for a CBRA.

To the OP - your previous posts relating to this subject have given good advice about your situation.

Yes you are right the child had no claims to US citizenship as my wife (the UCS) has not lived enough time in the US..

Does the child need to appear at the emabssy at in point of application or it can be dont by mail only?

Same as every other I-130 process - once the petition is approved, visa number assigned you do the medical exam and interview. The child won't be asked anything (still a baby) but you will have to bring him/her to the interview.
