The K1 visa is valid for one US entry within six months of its issue date. One it is used, it is dead. The foreign fiancee is required to marry the petitioner, in the USA within 90 days or leave the USA. Once married, your spouse remains in the USA and applies to adjust status to conditional permanent resident.

If a visa is not granted within four months of the petition approval date, the approval does expire but can be extended at the discretion of the Consular officer for an unlimited number of four month periods. Typically, when cases are sent back to California service center, they are simply allowed to expire without review.

Any needed extensions will happen automatically prior to the interview. What is the status of your case at this time?
