What does the NVC actually do? and how long does it take? How long until they forward petition to consulate?


06/30/06- sent I-129F petition to VSC.

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

09/25/06- called VSC, told to file expedited service, outside 60 days of RFE received date

09/26/06- sent expedited service request to VSC via fax and snail mail

09/26/06- Senators and Congressman making inquiries into my petition

09/29/06- expedited service request approved by VSC director

10/04/06- e-mail NOA2 approved!!!!!!

10/05/06- NVC received

10/06/06- NVC forwarded to Poland Embassy

10/16/06- Packet #3 received

10/17/06- Packet #3 sent to US Embassy Warsaw

10/30/06- Packet #4 received

10/30/06- Interview scheduled for November 22nd!!!

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

What does the NVC actually do? and how long does it take? How long until they forward petition to consulate?

I'm not sure, but I think they run some checks, assign a new number case to your petition and send it to the consulate.

As to how long it takes, a few weeks. Some have their sent after one week, some take a lot longer.


I only offer advice - not even legal. Just the plain and simple kind.

Some have theirS sent after one week, some take a lot longer.

(Just wanted to correct the spelling)

Also, from their site:

NVC processes all approved immigrant visa petitions after they are received from Citizenship and Immigration Services in the Department of Homeland Security (CIS) and retains them until the cases are ready for adjudication by a consular officer abroad. Petitions may remain at NVC for several months or for many years depending on the visa category and country of birth of the visa applicant. When an applicant's case is about to become current (a visa number is likely to be available within the year), the petition is forwarded to the appropriate U.S. embassy or consulate overseas. If an applicant is adjusting status in the U.S., the case will be forwarded to the appropriate CIS office upon request by that office.

One is assigned a case number. Name/security checks are also conducted at the NVC level. The time it takes is dependent on those name/security checks. It can be anything from a week or two, to months. Generally though it is only a short pit stop to be assigned the case number.

What is the name and security checks? I mean, she provides the police certificate at the interview, what is this check? I put a couple of her nicknames on the petition that she uses for "other names used" do you think this will effect the checks?

Name/Security checks are a normal process with NVC/consulates but the wait time at NVC is generally not too long as cases can and will be forwarded to the consulate prior to the name/security checks being cleared. If an advisory oppinion is requested this can cause lengthy delays. Advisory opinions are usually to do with a point of immigration law. Administrative processing (name/security checks etc) usually refers to a legally mandated security check the Department of State (NVC) must do for all applicants/beneficiaries over the age of 16. The length of time one can be held up in administrative processing will vary as some countries are subject to closer scrutiny. The process normally takes four to six weeks but as I said it can be much longer. Fingerprints are sometimes required at consulate level but this is all a part of the initial administrative processing that began at NVC. Once an interview is held a visa will not be issued until/unless clearance has been received. In most cases (again dependent of country), administrative processing will be completed and clearance granted well before an interview is even held.

Booo!!! I think with my past DUI history and compliance with IMBRA, I will be placed in Addministrative reveiw!!! :angry: I would do it if I were the USCIS!! I bet that's what will happen to me being the petitioner!! :(
