I am a bit worried about the fact that my fiance is losing his job by the end of February.

Our K1 Petition is still in the process of waiting for the Consulate Notification for Interview Schedule and we don't know where we are we standing now.

My fiance is looking for a job now and had some interviews but no Job Offer yet. He is far more willing to accept any job that will make above to the Poverty Line but still no luck. And as everyone know, economy is bad right now.

Any suggestions or advise of what will our chances of approval?

Although everyone feels for you in this situation (vo included), they still have to follow the field guide and that means a current job. It would be illegal to approve it when they for a fact that no one is able to support you once you got to the U.S. Can you find a co sponsor? Then at the interview you still have backup.

I found out that the Consulate that will process our Petition doesn't accept co-sponsor for K1 Visa. :help:

ok, you should update your timeline so maybe someone here from that region can help you out.. the more info we know the better advice to give you.

Sorry, I'm a newbie and forgot to fill-in the timeline.

Anyway, in our opinion, if (hypothetically) I will be scheduled to an interview sometime February, my fiance is still working at that time, we can still meet the requirements - we can still provide Employment Certificate, Affidavit of Support and Pay Stubs.

But what are the chances? What are the things to expect in this kind of scenario?

It's so overwhelming and crucial to be pressured about your career and financial status, and now even our life together is at stake. All of our built dreams together, family, love and life will be shattered in one big boom. Sorry, I'm sounding out. But I hope anyone can enlighten us.

If your fiance has a job at the time of your interview and can prove it with current pay stubs & an employment verification letter, then you will probably be fine. I would think this would be the case even if your fiance SUSPECTS that he will be laid off shortly - he hasn't been yet, so he still has an income. If your fiance is laid off and hasn't found new employment by the time of your interview, you will have issues if your consulate doesn't accept co-sponsors.

You'd probably benefit from posting this question in a region specific forum so that people who have gone through your consulate will be better able to advise on what kind of questions they ask about the I-134 - I'm sure it varies.

He's employed now. Have him complete the I-134 sign and date it now. Then send it to you with the appropriate supporting documentation and recent pay stubs. Generally a February I-134 that looks good will not be questioned in March or April.

Like others have said, as long as he is employed he should fill out the support documents and get them mailed off before he loses his job. It will be several months after you arrive in the U.S. before you are called for your interview. Hopefully he will have a job by then. I too lost my job in October shortly after my fiance arrived. We went ahead and filled our papers for AOS but I started my own business immediately and was able to include a profit and loss statement for evidence of support. I have since found a job, so if I get an RFE for additional support documents, I can now include payroll information from my new job. Good Luck, but the best advice is for him to find a new job ASAP. Remember too that support documents include tax returns for the entire year, so if he made enough in 09 to qualify and he gets a new job in 2010, the job loss will only be a "blip on the income radar screen". Enjoy the journey.

Go with what pushbrk said and you shouldn't have a problem. Make sure to look for a co-sponsor anyway because you will need them when you adjust status.
