hey friends. its been a while. were just putting together our AOS packet now and have a few questions. im sure we will have a few more before we are done.

on the i-485, what would ellie's (my wife, the beneficiary) USCIS status be? she came into the states on the K1 visa and we just got married last week. also, we're not sure what the expiration date on that status is. is it the expiration date listed on her visa that was inserted into her passport (may 20 2010) or 90 days from when she entered the usa (march 5 2010)?

also, do we have a nonimmigrant visa number? is that the control number on her visa?

on 2009-9-30, dos was finally able to tell us that london processed our packet 3 forms

Packet 4 Received :

Interview Date : 2009-10-22

Medical Date : 2009-10-23

Interview Result : Approved! (received visa 13 days after interview because medical results were pending)

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

I'd like to ask some. What immigration status of me after I applied AOS? My current status is K-1 and only have 90 days period. If AOS takes time beyond this period, what will be next?

since they have your AOS packet before the 90 days, you are fine. i believe your status is still K1 visa holder until you receive AOS.

since they have your AOS packet before the 90 days, you are fine. i believe your status is still K1 visa holder until you receive AOS.

But when I went to SSA office, they told me that they will issue me SSN card after verified with USCIS. Normally, by their regulations, I can be issued the SSN card with my current K-1 status but they didn't. Plus, I went to DMV office for DL, they also told me my stay not enough and will expired soon and even I apply for DL, they won't mail me card and need the notice of jurisdication from immigration. I can't do anything else besides waiting for AOS. Even for buying marriage certificate, county clerk recorder asked me to apply sworn statement with notarized (I need to go notary public office:$15 for notary). How come so complicated! We had already married in the Church and the priest had mailed our documents to the county office. Hoooooo.....

Once you apply for AOS, your status becomes "Adjustment Applicant"

It means you are allowed to stay in the US, and if issued an EAD, you may work, and if issued AP, you may leave the country and be allowed back in (barring overstays which would incur a ban which AP does not override) until they have made a decision either way on your case.

After your I-94 expires, you probably won't be able to get a social security number until after you get your EAD.

I found that it is important for Nik to have his social security number for other things besides working - signing up for my health insurance was a big one. If you have needs like that, be sure to let them know. They can issue one to you for such circumstances - bring evidence. For the adjustment applicant, what document or stamp immigration will give?

Your receipt notice is proof of your applicant status. It's pretty flimsy, in my opinion.

K-1:
