Hi all,

I have a question about the K1 and H1B/L1B visas.

Me (beneficiary) and my fiancée are currently, as can be seen on our timeline, in the process of acquiring a K1 visa.

Prior to submitting the I129F I tried to transfer via my company (a huge american IT company). It was very slow and I didn't have much luck due to various reasons. Now however, two months after filing the I129F things seem brighter on the transfer front and I was wondering how to go about this if I was to be transferred and thus receiving a L1B (maybe H1B).

H1B/L1B is not an immigration visa, K1 is... will that cause me problems?

If I get transferred, should we cancel our K1 application?

Basically, will it somehow turn around and cause me grief in the future?

Any insight or comments are appreciated.

You do not have a pending K-1 visa application... you have a pending I-129F petition to determine eligibility to apply for a K-1 visa at a later date.

An H1B & L-1 are both non-immigrant visas (as is a K-1 believe it or not). An H-1B and possibly the L-1 are also considered "dual" intent visas so the intended visa applicant CAN have immigrant intent... So I see no real issues with a pending I-129F interfering with a H1B/L1 application. If it occurs, then withdraw the I-129f if that is what you choose
