Hello, I wasn't really sure which forum to put this in (K1, K3?). Anyways, my g/f and I are both in the US now and she is due to leave on Jan. 15. I went to visit her in England 2 years ago and she came out here for about a month last year, so just getting married and filling for an A.O.S. is out of the question.

We're trying to figure out if we should just get married before she leaves and then fill for a K3, or not and just fill for a K1. We really didn't want to go through the A.O.S. after she has already got the visa, but from what i read it sounds like we will have to that either way. We would really just like to which option would be easiest and/or less costly for us.

Get married and do a CR-1. Way better visa without having to do AOS.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You should shoot for a CR1. The wait to be processed is a tad longer, but your girlfriend/wife reenters the states, she will already have a green card and will not have to do AOS, unlike us K1/K3 unlucky buggers.

CR-1 avoids the AOS, as others have said. But also consider where you want to get married and how big a wedding.... if you get married now, before she leaves, you probably have a small court house wedding. Nothing wrong with that, but it means you will have few friends and family there, especially from her side as there won't be time to travel. If you marry in her country, all her family can be there which is important to many women.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
