Have anyone apply for a K-2 visa. My fiance'e haven't seen the father of her child,since she told him that she was pregnant. Her daughter is now 3 years old. Do she need a letter from the father,stating that the baby can travel with the mother to the U.S.

Is the fathers name on the birth cert?

Yes, we have done a K-2 and K-2 follow to join for our sons. As Sjr mentions, is the father listed on the birth certificate? If no, you should be OK, if yes, then she needs to find him OR get a court order of sole custody wih transport privilege.

Not sure what you mean by "sign". Is he listed on the birth certificate as the father?

If your child's father is not listed as "father" in the birth certificate and the child is not using his father last name as legal name. Then you're OK to do K2 with no trouble.

But if he does using the father's last name and father's registered as father in BC then you have to consult the Child Welfare in your place to get some paper works about sole custody of the child.

I filed k1/k2 year 2006,.. my son was 3 years old at that time, the father signed and acknowledged that hes the father, but still my son is using my name... and never had a problem at all. We went to DSWD ( Department of Social Welfare and Development) and asked about it, and they said, as long as the mother is not married to the father of the child, the mother will have the sole custody.

Its gonna be fine.

Thank you. I had remembered reading something about this variation in one country or another but wasn't sure which. Thanks for the reminder. Others should be advised this is a situation unique to the PIs (and possibly some other countries). In most countries it does not matter whether the parents are married or not, if the father is listed on the birth certificate, then permission and/or court orders are needed.
