I am married to a US citizen, in the USA as a visitor from Canada. I am sending in all the required documents I-130, I-485 etc. so I can be with my husband and work.

On the I-765 petition to work form, do I put a-9 or c-9 where it asks for the Eligability under 8CFR274a 12? I think I'm goofy from all the forms and can't seem to clarify for myself. Any help would be appreciated :)

OH! I also don't have any of the alien numbers (I-94 or something) or visa numbers that are asked for on these forms so I should be putting "none" or "n/a"?

Hi omabern.

The first step in your immigration process is for your husband to submit an I-130 petition along with supporting documents and fees to USCIS.

The I-485 (Application for Adjustment of Status) and I-765 (Application for Employment Authorization Document) are not submitted yet.

These applications are sent in AFTER you have gotten a K3 visa (non-immigrant visa for spouses of U.S. Citizens), CR1 visa (conditional permanent resident visa for spouses of U.S. Citizens, this is given if you have been married for less than 2 years), or an IR1 visa (lawful permanent resident visa for spouses of U.S. Citizens, this is given if you have been married for 2 years or longer), and have entered the U.S. using any of the visas mentioned. You will receive an A# (alien number) after your petition(s) have been approved.

The VisaJourney Guides are an excellent source for helping decide which visa path you wish to take. You may want to read about them first so you know the difference between them and get an idea about what the requirements and timelines each path takes. Hope this is helpful.

Hello.

Thanks for responding. We have already been told on this board to submit both together and the instructions also suggest both can be submitted at the same time.

Is this incorrect?

Thanks again.

You are adjusting your status from a visitor visa then? You should do some exstensive reading on that. Be sure that you can prove that you didnt visit with the intent to marry, stay and adjust.

You should also ask an organizer or mod to move this to the AOS forum. This is the k3 forum and while we all eventually will do AOS, its not the same situation(or category) and you will get more advise and guidance there.

"you fondle my trigger then you blame my gun"

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

Hello.

Thanks for responding. We did submit the I-130 with appropriate documentation so now we wait to see what the verdict is.
