Good Evening All,

I had a few concerns I wanted to address and any feedback would be greatly appreciated.

I recently just signed up today and my fiance and myself have been breaking our heads with the anticipation of the issue. My fiance is from Japan and I live in Jersey U.S, we met online and after a few emails and a phone call we decided to meet since she was already here on a tourist visa local to where I live. It was honestly love at first sight once we met, I am a pretty skeptical guy and being from the city there are alot of options but there was something very special about her and I knew instantly that I had found the one. Since that day on we were inseparable now we met on March 07, 2009. She originally arrived in the U.S in December 2008 but she had received advice from a friend to fly to canada and get an extra 3 months extention which she did and it worked prior to us meeting. Before we knew it was June and her visa was soon expiring again she advised me that she wanted to stay and she told me what she has done prior and myself being ignorant to the situation I said sure. Now this is where it gets messy, she stayed for 2 days in canada and on her return she got stopped by U.S immigration in which they denied her access back into the U.S they stamped her passport and they would not let her come back to the U.S to get her things or anything of course and she immediately had to fly back to Japan. After alot of thought we decided to marry (not just because of the situation but more so because we are very much in Love) and file for the K1 visa I-129f form on June 12, 2009. This form is currently still pending my first question is will they deny us because of this situation since she has overstayed for only 3 months? We both have clean records!!!! Second question is it looks as though some couple receive approvals faster than others what is the reason for this? Some folks I have seen approved less than 3 months. Whereas the avg. looks to be about 4 months from 1st NOA to 2nd NOA.

Don't worry about how long it takes! Just worry about if "it takes"!

They erase the history of you overstays after a certain period of time. I don't know exactly how long that takes. It could cause problems to obtaining a visa but it doesn't hurt to try and keep going for it. Why people get their approvals faster than others? I don't know. Some cases, they have to research deeper. Then there are some people who are stupid and lazy to get their work done. I got my NOA2 after 7 months. Some people have to wait longer, some get it in less than 3 months. Its a long and painful wait, but it was sure worth it. Good luck to you and your fiance.

September 6, 2008 - Mailed in I-129F to California Service Center.

September 11, 2008 - NOA1 Received.

December 18, 2008 - Touched. (Change of address made.)

April 16, 2009 - NOA2!!!

April 20, 2009 - NOA2 hard copy received.

April 21, 2009 - Case sent to U.S. embassy in Japan.

May 8, 2009 - Police Certificate requested.

May 19, 2009 - Police Certificate received.

May 21, 2009 - Packet 3 received!

May 22, 2009 - Packet 3 sent.

May 26, 2009 - Medical Examination @ Tokyo British Clinic.

May 27, 2009 - Request interview.

May 28, 2009 - Interview date received.

May 29, 2009 - Pick up Medical Exam results.

June 20, 2009 - Bronson comes to Japan!

June 22, 2009 - Interview (8:30am) Passed!

June 27, 2009 - Passport with visa received.

July 7, 2009 - POE Hawaii.

August 1, 2009 - Wedding.

September 28, 2009 - Sent I-485 to Chicago, IL.

October 6, 2009 - NOA.

November 10, 2009 - Biometrics.

December 1, 2009 - EAD approved.

December 9, 2009 - Employment authorization card sent.

January 21, 2010 - AOS interview 12:30

January 22, 2010 - Card production ordered, notice mailed welcoming the new permanent resident.

January 29, 2010 - Welcome Letter received.

February 2, 2010 - Approval Notice sent.
