Hello,

My wife and I were married in the US and filed for both the I130 and K3 visas. My wife is in Canada and is back and forth until the process is complete. We received a letter from NVC stating that our I130 has been approved and all of the information has been forwarded to the consulate in Canada. I called to confirm and was told that we are in the cue for our interview, but she does not know when that will be it could be October, November etc.

2 weeks ago we received a notice that our K3 application was approved and my wife has since received a package instructing her to get a medical and send in forms such as; a DS230, DS156 etc. It also included a check list of things she will require to have once an interview is scheduled. The package for the K3 indicated that once she sends all of the required forms it could be 4-6 months before a interview is scheduled.

So..my question is can and should we pursue both the K3 and the I130 or should we simply prepare ourselves for the I130 interview and forget about pursuing the K3? How long does it usually take once NVC notifies you that you are in cue for an interview? We have been assigned the consulate in Montreal, Canada.

Any assistance would help us sooo much! Thanks in advance:)

In my option you may want to think about droping the K3 and go for the CR1. The CR1 has way better benefits, he/she will be LPR with green card SSN and no AOS and it’s cheaper!

I agree, doing the K-3 now will save you a few weeks (maybe) but cost you almost twice as much after you adjust status . I'd ignore the documents for the K-3 and pursue the Cr-1 - it is a superior visa allowing for work and travel immediatly upon entrance into the US.

Montreal is s-l-o-w when scheduling interviews. Look for about 2 - 3 months after NVC to get your interview.

Good luck.

PS - fill in your timeline, when was your case complete from NVC?

Ok, it looks like you received your USCIS NOA-2 on March 4. Your I-130 was sent to NVC, have you followed the LingChe short cuts to speed yourself through NVC? Have you done anything on your I-130 since March?

http://www.visajourney.com/wiki/index.php/...he_NVC_ShortCut

I-130 needs to go through NVC first, the I-129F (for the K-3) just flies through NVC on it's way to the embassy. Not so with the I-130

Good luck.

we got the approval at the same time for both K-3 and IR-1 but decided to go with IR-1.. apparently USEM in Pakistan isn't putting many K-3's on AP since its not like they are giving green card right away but IR-1's usually go on AP for long.. if we had known about this, we might had gone for K-3 but no regrets.. it's almost over!

Go with CR-1 since your consulate won't give you any problem like that!
