Hi everyone. My husband and I filed the I-485 petition in June and today we received an RFE because his birth certificate was registered this past March (2009). USCIS is stating that this birth certificate is a delayed registration. They are asking for an original birth certificate dating from his actual birth or school records with both his and his parents names on it. They will also accept baptismal certificates or a hospital certificate. Now here is the problem my husband has an original birth certificate but on it is his mother's nickname instead of legal name. This is why he traveled to his native village this past March to get a certificate with his mother's legal name on it. What advice does anyone have? On the RFE it states that we can submit affidavits but is there another and better option? My husband lived in India up until now and they do not keep many records. He has no school records with his name and his parents name on it. Also, he is Hindu and clearly has no baptismal certificate. We are thinking of submitting the original birth certificate with an affidavit that that is his mother's nickname and then an additional affidavit attesting to his birth and the verity of the birth certificate. We can get some other family members to sign these affidavits. Has anybody else been through this situation or even heard of this rfe before? We would really appreciate some advice or help. Thank you!
