I am a current college student and don't have make enough to make over the poverty line. but I do have a sponsor and also my parents (intending immigrant) works which puts me over the poverty line and able to provide support to for my mom.

while filing out the i-485 I included my mom's income as a household member and i was able to show evidence with her ssn and her taxes for three years. but not they want evidence of her work permit or something that shows it's lawful. Which I don't know what I would be able to show since she is a canadian citizen who entered in the US without inspection and applied for a ssn card without a work permit and was able to work. Without my mom's income it would still be feasible for the sponsor to cover the income but I don't know what evidence or any documents to submit before the 87 days are up.

Please help me out. Thanks so much!

Only US citizens and Legal Permanent Residents may be a sponsor or cosponsor. From what you say she is neither.

If the sponsor's income is sufficient then you did not need a co-sponsor (if am understanding it correctly).

Since you submitted an unqualified co-sponsor anyway (at least not qualified from an I-864 standpoint) - you'll have to (in my opinion) withdraw that affidavit of support (since you can not supply the necessary proof of citizenship or permanent resident status). It is a problem that doesn't come up that often.

Previous post related to this topic and OP: (I'd be curious to hear more - especially in response to meauxna's post at the bottom of the thread)

What is the basis for adjustment of status? The immigrant married a USC? Petitioned by parents? USC/LPR petitioning for parents?

The immigrant is the petitioner for the I-485.

There is no place for income to be listed on the I-485, there is income listed on the I-864 Affidavit of Support. Is the I-864 where the mother's income is listed?

I am USC petitioning for parents. for the form i-485 it wanted me to include the i-864 AOS. That is where my mother's income was listed. ( on the i-864)

thanks
