greetings to everyone! this is our first post here. we learned a lot of helpful things here about the visa processing.

I would hope that we would get a help or advice on our problem with our application.

We already got approved from USCIS last May 22nd and keep track on the papers on NVC where unfortunately returned back to USCIS for not telling us the reason.

USCIS changed our status case to "on review". Then, just few days ago we got a letter from USCIS (Decision Notice)

It says: Our petition for K-1 was been approved with a validity of 4 mos. last 22nd May and has been forwarded abroad to the US Embassy/Consulate but subseqently where not issued a k-1 visa, therefore the petition has been expired and was not revalidated. But the petitioner can chose to file a new I-129F for the beneficiary with fee."

That letter made us so shocked. How could this be happening? how did we get expired? our papers didn't get to the Manila Embassy yet. We tried asking the Manila Embassy quiry, but they don't give advice or answer, they only tell that they had no jurisdiction on it and just giving the USCIS hotline number.

Does anyone been like ours before? or just anyone who can give us advice and help? this is just making us so frustrated and so sad. Please do help us?

Ouch - it might be that NVC sent a RFI and you didn't respond?

Something screwed up - did you get the NOA2? I would be on the phone with NVC and USCIS.

The embassy doesn't seem to be involved with the info you gave, so I doubt they could help you.

You have to find out if NVC sent it back, or if they actually sent it to the embassy...

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Call NVC. USCIS just sent you a standard notice where somebody picked a standard paragraph. USCIS tends to say "forwarded abroad" when they are actually forwarding the petition NVC. NVC has your answers. Speak to a human there.

It was the NVC that told us that they returned it back to the USCIS with no explanation and just told us to just call the USCIS number for further questions and after so many tries of talking to a person there..we finally succeed but to the worst that the operator told us that was it what it says on the notice., however explanations we did.

We didnt got any letter from NVC asking us anything. and we been calling once a week since our paper sent there to NVC, to check if they already send it to manila, then after 1 and half mos. they said that they returned it back to USCIS

You might try talking to a visa specialist in Washington. You have to wait ten or fifteen minutes to talk to a visa specialist, but in our experience it was worth the wait.

I was just curious if you had an update on your returned petition.

it seems NVC also sent my approved petition back to uscis. it was at nvc for a week, and i was told it was in processing. i called today and was told they returned it to CSC and i would have to wait for a letter from uscis. and tat would take at least a weak for it to get to CSC.

and yes we have the actual approval noa2 that was sent to us, and copies of the approval email as well on august 7th. After being delayed at uscis i do no know what to do. we already had our congressman get involved at 5 months to get our petition moving at csc and now this.

what is weird is that today we got mail form nvc dated a few days ago that it was forwarded to the consulate.

i am so confused right now and upset. :(

Hang in there. My process took so long but in the end my finacee finally received her visa approval (8 months later). It will get resolved. Just don't let your frustration get you down... Good Luck...
