No Copy of Naturalization Certificate to file AOS

Hi All,

My husband became citizen this morning and received his naturalization certificate. We prepared all AOS forms and documents and were ready to send them today. He went to passport office to file for passport and he was above to make the photocopy in the office they didn't let him make any copy and told him that's illegal to make copy of naturalization certificate.

Now we do have the number of certificate but we don't have any photocopy since they have taken him at the passport office with passport application. However he has a letter from senate to conguratulate his citizenship.

I am freaking out now no idea what to do? Already I don't have my birth certificate back from India which is my country. Please advice.

Should I just send all the forms with his naturalization number and the cover letter with no copy of certificate

Should I have to wait for his passport to arrive to send all the forms.

Please advise any comments and opinions will be appreciated.

You have been misinformed. You can photocopy your own certificate for lawful purposes.

Quoted from my certificate:

"IT IS PUNISHABLE BY U.S. LAW TO COPY, PRINT OR PHOTOGRAPH THIS CERTIFICATE, WITHOUT LAWFUL AUTHORITY."

I made a copy of mine and submitted it with my 129F K-1 application, it was for a lawful purpose.

He has added my name in the passport application as spouse "WIFE" and all of my information. Does that help when he gets his passport and if I apply that with the proof of naturalization with my AOS.

I am confused. Please advise and give us any comments would be helpful.

My husband became a citizen last year and we just sent off our AOS package today, for me to become a permanent resident and if you read the instructions on I-864 checklist is says:

For U.S. citizens or nationals, a copy of your birth certificate, passport, or certificate of naturalization or citizenship.

I suggest you wait till you get the passport and just make a copy of the naturalization certificate, it's not illegal.

I believe, that is "it is my opinion", that evidence of US Citizenship should be filed with the AOS. Others may correct me on this.

It is also my opinion that you should NEVER send an ORIGINAL Certificate of Naturalization ANYWHERE, they are expensive, and it takes a year or more to replace. I make an appointment and have my passport issued in person.

I once lost my certificate, I forget the cost, it was expensive, and it took almost a year and half to have it replaced.

Shelly Thank you but he doesn't have a copy of naturalization now they have taken from him in the passport office. Currently I do not have any proof of his naturalization other than the NC # we noted on I-130.

My husband is saying we can just send all the papers without any proof since we have the number listed on I-130 but I will not agree with him. They will simply return the package back or probably send RFE.

What else he can do to get his certificate back. He is getting angry since I am forcing him to get his certificate back from passport office. Forget about the AOS FORMS even if he needs them for any other purpose he will be in trouble but he is not trying to understand that.

I have no idea how this is going to work out in future in case if he needed that for any other purpose.

Yes, they will return and give you another 60 or 90 days just to send a copy.

Don't know if the procedure has changed but when my husband applied for his passport it was a requirement to give them the original certificate and girl within 2 weeks in the mail he got his passport and his original naturalization certificate.

Oh thank god. I was furious thinking that he is not going to get his certificate back. That's ok we can wait until he gets his passport to apply for AOS forms its not that urgent right now since I am holding valid H1B and I am also 33 weeks pregnant so we might ended up waiting until I give a birth to the baby and attach her Birth certificate with AOS forms as a evidence of bonafide marriage.

It's me again right now I am on shorterm disability and I will be out of the job after my delivery so I might loose my H1 status. My husband suggesting we can apply now with the letter stating that he didn't take the copy and submitted for passport since it says not to copy or photograph the certificate. Will that work?

As of (Wednesday July 29, 2009 ), we are processing routine applications in approximately 4-6 weeks from the time of application.

I would say:

Prepare all the forms and documents

Wait for his passport to arrive takes about 4 weeks

Submit a copy of the Certificate

Do not confuse USCIS with letters, they will just mess everything up, turn back your papers.

If you are on H1B and the status is terminated you are out of status but this should work out. Since US citizen's spouse entered with inspection and even though overstayed the visa, the spouse is still eligible to adjust status.

PS: Always have copies of all the forms you file with USCIS and all the forms (certificates and passport, visa, I-94 etc. in a safe place) Keep copies of all your applications and immigration documents, you may never know when you may need them. As soon as you get them back, make copies for your records, keep in safe place.
