my fiance just left the Lagos consulate and was denied based on the fact that the pictures we attached to the form were our engagement pictures. The CO said in Nigerian the engagement i considered marraige and I should have filed a K3 visa. I dont have any marraige certificate to do this bcuz we didnt do any registry. WHAT DO I DO NOW?? pleaase help me

your question doesn't make any sense. But I will try to answer it the best i can. What kind of visa petition was filed? If it was a visitors visa then what you have done was given intent of immigrating to the USA. Thus, the denial. For a visitor's visa your fiance must prove without a doubt she will be returnin to Nigeria. ei. good job. owns land, owns business, good income etc Now what you have done by giving the CO those pictures is told him she has intention to immigrate and not return home when her visa is done. THat's the only reason I can think of because you have provided NO details on the petion that was filed.

Plz provide more specifics so we can give you a more accurate response thank you.

Well - if they consider the engagement a "marriage" there is nothing you can do but file for a CR-1/K-3 visa.

You will probably need to go to Nigeria, get your official marriage certificate then proceed from there.

Perhaps someone from Nigeria can shed some light on this, this is the first time I saw where an engagement was considered "marriage".

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Well - if they consider the engagement a "marriage" there is nothing you can do but file for a CR-1/K-3 visa.

You will probably need to go to Nigeria, get your official marriage certificate then proceed from there.

Perhaps someone from Nigeria can shed some light on this, this is the first time I saw where an engagement was considered "marriage".

thats the problem. there is no marraige certificate. we are not legally married. In nigeria, there is a ceremony where the families meet with one another and bascially consent to the joining of the 2 families. There is no justice of peace or religious priest at this ceremony. Its just a formal introduction of both families. I cant file the K-3 visa.

There is no marriage certificate because they did not get married. To me is just sounds like the typical things that happen at the Lagos consulate......denials there are not always based on the reality of the evidence presented. If they file for K3 they will not get it because there is no legal proof of a marriage.

I think you should do what others have done. Contact the Lagos consulate and speak with a supervisor. You should have been given something in writing which states the basis of the decision. Were you given something in writing?

Did you demand to speak with a supervisor....not just call and speak to whom ever answers the phone, but you need to speak with the person who is over the one whch interviewed the beneficiary, before your case is returned to the US.

Also what exactly did the written reason for not giving the visa state?

well, i didnt speak to a supervisor. i will call back. denial reason states that Im not eligible for a k1 visa cuz we are considered married

I have read on here several cases where people spoke to the person above the interviewer and had reversed decisions. It might be worth trying that. If they are questioning whether a marriage took place you might want to ask if you can provide proof from the court that no legal marriage document exists. The court should be able to provide you with some sort of written document attesting to no marriage document existing after a search for a document.

It's worth a try anyway.

Among some Nigerians, what you did is consided marriage according to the old tribal traditions, i.e, family consent with witnesses. It does not need to be recorded anywhere nor does there need to be an officiant. Had you been there for the interview, maybe the result would have been different. Nigerians are among those who will look for any legal reason to enter the U.S.

What does your boyfriend's family say about this?? Lagos is difficult in any event, and unless you get that decision changed, and because it will take months to appeal it, best thing is to go for a spousal visa.

The consulate knew darn well that was not a marriage. I would try to make sure that it does not leave the consulate, and state your case. Also write to your Senator. Again redundant, proving you are not married is a required document. Produce that.

I am Nigerian and from a tribe which upholds tradition and despite paying the bride price, my wife cannot move in with me until I wed her in the church. I don't know which Nigerians you are talking about but your marriage has to be recorded for it be considered legal. Don't come on here giving false information please and if you don't understand a culture or tradition, don't claim to 'cos it's offensive. You can't appy to USCIS for a K-3 with family consent, you do so with your marriage license and even if it's Nigeria where I am sure they get cases from, they will ask that of you. Her being there at the interview would have made no difference IMHO, since the CO made a statement in the lines that Nigerians see the K-1 as a faster option.

The OP cannot apply for a spousal visa because she is NOT MARRIED. USCIS will instantly deny her K-3 application and throw it in the trash. What she needs to do is make sure this case isn't returned because what the CO has done is very wrong and unethical. They know pretty well they are not married but those CO's in Lagos like to mis-use authority given to them.
