Service Center RFE... They are kidding right??

Hi everybody!!!

Today i checked my case status online, like i do everyday since Feb, and I saw there was a change in the status... But when I opened the file it didnt look like a nice thing:

Here is what they say:

On July 9, 2009, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your mailing address.

Is that normal?? I havent read anywhere on the forum about RFE from the service center, I thought u could get approved or denied.... What is it???

Please someone HELP ME!!!!!

ummmm....how about waiting and following the directions regarding the RFE....OR...calling USCIS and finding out #######....

I don't know about the notice they sent you, bu me & my hubby got an RFE.. ours stated that the payment for the I129F was not included in our packet, but the receipt for the I130 was inclosed.. (once lthe I130 is paid for, there's no fee for the I129) so I had to write a letter stating that, and send another copy of the NOA1.. it was a pain in the axx.. ...hope all works out for you

Ok, thank you very much for your advices....

Now I have another question, seen that probably the evidence needed is here in italy, will they accept if i send it from Italy via UPS? Its a little expensive, but they guarantee the next day delivery...

They will accept it from wherever it is mailed. They just want to get the missing information. Wait until you get the actual RFE, however, as you need to include that and send it back with the requested material. They often give you a specific address to which you need to mail it as well. Good luck.

I finally got the mail, they ask me for an official marriage certificate, and 2 passport size photos of my wife (that is the petitioner)...

My wife sent them the marriage certificate, but it was not translated, i guess that was the problem... anyone had the same request???

Yup, we had a request for our marriage certificate as well. NO worries, just send it in as soon as possible and your NOA2 is around the corner!

Ok, of course now in Italy im having troubles to find someone to make the official translation... If theres anyone Italian who did the same thing please let me know where can i go...

Definatly agree with other posters this is a step in the right direction for sure!

Sure, everyone got the same request. It's in the instructions for filing the petition.

That is probably a step in the right direction, but the evidence is here in italy, and they request the notice they sent us in original with the evidence... so my mother in law sent me the NOA as soon as it arrived, but from the 15th i still didnt receive it... and is not only that im wasting time on this, but also that i have an expiration date on aug 12th, and i cant send the evidence without that notice...

How funny is that, its coming up after 6 months that we'll probably have to do all over again...

What are you saying has an expiration date? Yes, if you don't respond with the evidence in time, you'll be starting all over again. It's a bad result but one that could have been avoided by carefully reading and following the instructions that come with the I-130.

they said they mailed on July 9th? did you receive the mail?

The NOA arrived at my mother in law's house, she scanned it and emailed the scan to me, then she mailed the original NOA at my house in Italy, because the evidence needed was here, so I have what they asked me ready to be mailed out, but it clearly says on the NOA that we HAVE to send the original along with the evidence, and now we don't have the original, we called the USCIS and they said that they want the original and no copies or scans....

You are absolutely right, I work in Italy as a contractor, and I know that you have to read everything 3 times, and you are lucky if you dont miss on anything, but I couldnt be the one to file the petition for myself, for the only reason that I was in italy, or else we wouldn't have gotten any request for evidence... After all it was clearly written what they ask for... But you know, who never had to deal with legal papers just think of it like "ok, whats the worst thing that could happen" or "what they need this for??" and actually, this is it, wasting 7 months waiting for a paper, and then not beeing able to accomplish on anything, and everything turns into a waste of time and money...

Got the request for evidence, sent out the papers they asked me, and the VSC received it...

Now Im expecting to get an approval, and then hopefully at the NVC...
