So what happens if you are married within the 90 days but can not file the AOS before the I-94 runs out due to money or lack of a job for the Support document?

Got a call with questions from the embassy3/9/09

Request sent to State Dept. to remove ineligibility status: 4/19/09

Approval letter recieved: 4/25/09

Pink Sheet: 4/27/09

Visa Received : 5/19/09

This topic has come up a lot recently on VJ. It's really a precarious situation if you don't get the AOS done. If she has to make an unplanned trip back for an emergency, you can't file for Advance Parole. If for some reason you folks are stopped and they run her status, that could lead to removal proceedings. (that's one instance on here)

It's a lousy economy, and I am not being heavy handed, but do everything that you can to get the AOS. Don't take the chance after all that you two have already gone through.

I'm sure people will have lots of info to give you one way or the other, but in reality, it's really best not to wait, and the above thread is one of those reasons. At least know the risks.

Find a co-sponsor. Its not fair to your wife to keep her out of status.

I know the economy sucks.

The economy sucks and doesnt appear the job(s) situation will improve anytime soon with more layoffs to come for some of us. I'd get two part time jobs to bind together as enough for the minimum requirements. Besides, by the time you have the interview you may find one full-time job to replace the two part time jobs with better income as well.
