Please visa journey members help us if you have any suggestions about this. Is it possible to petition my fiance now that i have no job and was laidoff . :crying: I am currently recieving unemployment benefits and still meet the $$$ amount of the support for two of us . But my benefits will run out in october. I am trying to file a k1 for her to be with me. It kills me not tobe with her now. I was reading the guideline section and came across the i-134 form Affidavit of Support form and asked me were i am employed ? Now what do i do ???

A job is required unless you have a lot of $$$$ in the bank or lots of assets that are worth a lot.

But the 134 is due when she interviews so by that time, maybe you'll have a job. Interview is around 5 months after you file K-1.

They want to see you can support and continue supporting the beneficiary. You can file now if you want but need to show you can support her when the interview comes up in 6+ months from submittal.

You can try to get a co sponsor.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

you can file now and hope that you will find the job by the time of your interview, is really difficult by you need to put your mind together.

CO-Sponsor is what you will need unless you have a steady job by the time of the interview .... you have to provide a company letter head stating your position with the company .. salary .. temp or perm etc ... so even though your unemployment meets the poverty guidelines ... you will fail to prove your fiancee will not become a public charge once in the US ... good luck in the job search and or sponsor.

So many people are now unemployed that your situation is not unusual. By all means, file the petition and then hope for the best by the time she is called for the interview. Also, you'll have the time to look for a family member or friend to be the co-sponsor.

You do not submit the I-134 with the petition. YES you can petition your fiancee without a job.

You will need to provide support information for the interview. Maybe you will have a job by then, probably six months down the road. You can always get the petition approved and delay the interview OR line up a co-sponosr.
