If I94 expires while waiting for AOS process to get approved, would that be a problem.

Also, we can't get photo I.D.for state of CA because they say tht I94 is expired, what can I do about that. Is there somthing I can show to get I.D. Done?

As long as you have the NOA for the AOS - your good to go.

However, if it was more than 180+ days between the I-94 expiring and the NOA - do not leave the country, even if the AP was given.

I don't know if they will accept the NOA in liu of the I-94 - you may need to ask.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Most states like CA want evidence of legal presence before they will issue a state ID (DL).

Evidence like:

  • I-94 valid for 1 year or longer
  • EAD card
  • Green-card

Is now a US Citizen immigration completed Jan 12, 2012.
