Hey guys,

I am a non US citizen (H1-B) married to a US Citizen (by birth). We had our interview today. The interview went well, but the officer asked for Credit Card Statments and more bank statements (we have one combined account and had statements for those) and have individual accounts as well.

He then gave us a letter and asked us to post the documents in 30 days. The letter said Additional documents required. Please submit credit card statments, bank statments and other financial documents since marriage ( 8 months ago).

My question is this common? will we be called for a hearing again ? also, the officer, took my i-94 and i didnt get it back, is that okay ?

Yes, if they need more evidence of "joint holdings" to prove bona fide relationship.

will we be called for a hearing again ?

Maybe, if they have questions of the evidence you submit.

also, the officer, took my i-94 and i didnt get it back, is that okay ?

As noted above - normal.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thank you all for your replies. Sorry for the long reply !

The problem is that unfortunately we do not have too many joint holdings.

When the officer gave us the letter it said "Provide Statement Copies all bank accounts, credit cards and other financial related document, for both you and your spouse from the time of your marriage to the present".

I asked the officer does it have to be combined accounts, because we do not have combined credit cards, he said no ! they can be individual.

This is what im planning to send - please advice suggest what else i can do ?

Petitioner: ( all eight months statements)

Primary bank account (single) + copy of check

Combined bank account ( with spouse)

- no check book since she was added on later.

Credit card (joint with her mom)

Benefictionary

Primary bank account (single)

Combined bank account ( with spouse)

three credit card statements

- i have couple more that have balances that are being off monthly but no activity - do i send those also ??

401K - spouse added as benefictiary

Plus, my wife got a job after we submitted the application, she was umemployed at the time of the original application.

So im submitting her pay stubs, and her offer letter.

We didnt have our 2008 W2's at the time of submission of the original application. So submitting copies of W2 and most current tax filings (2008 filed as married filed jointly). I had this at the interview this morning, but was never asked for it.

Please advice if there is anything else i can send.

I would send the joint tax forms. If you filed joint state taxes, you can send those as well.

I wouldn't send copies of the individual account statements, because that doesn't help you prove you have a valid relationship. Instead send the beneficiary pages from those single accounts showing that she is the benficiary (and vice versa).

Adding someone to a credit card account can usually be done over the phone fairly quickly. I would add each of you to the accounts and ask them to rush the cards. You can send copies of the credit cards with the same account numbers in both names.

Do you have a lease or mortgage together? You could send a copy of the agreement.

Send the beneficiary records for all 401k and stock accounts.

Life insurance documents showing the spouse as the beneficiary.

Show that her and your credit cards or other financial obligations are paid from the shared account.

Doctor bills or utility bills in both names or paid from the shared bank account.

Her medical bills being paid by your insurance or vice versa.
