Hi Everyone,

Our I-751 was approved this week! My question is this...when can we apply for the N-400? . I was able to talk with CSC and the woman said that as long as my husband's status was approved we could apply...even though it is less than 3 years...

Everything I have read states that we have to wait 3 years less 90 days. This would mean that we would have to wait until July to send in the N-400 which would be 90 days before the 3 year mark.

If I send in the application early...what will happen? :wacko:

You can apply 90 days prior to the 3rd anniversary of your green card, so if you green card was granted in May, 2006 you can apply 90 days prior to that date in February 2009. Unfortunately, when you call the 1-800 number you get answers which are inaccurate - they are call center employees with scripts and are not familiar with actual immigration information, thus their nickname the "misinformation line". If you send the application in early, they will send it back and tell you that it was submitted early. It is best to wait until July - it is only a few more months.

I read at least twice on this forum of applications being rejected because submitted too early, one was just 3 days early. I would just wait till July, have the file ready and mail it on the eve of the 3rd anniversary minus 90. Good Luck!

your application will be rejected if you send it early.. so line up, send on time like we did

just count 90 days from your 3 yrs as a LPR and sent it then, just make sure its not even one day early. I have seen people rejected for one day early... if you are not in a rush, just get it in sometime within the open window... I filed mine about a day into my 90 day window (friday) and it got there on monday morning.

Mailed N-400 March 6th via priority certified mail and Rec'd 9th (confirmation by USPS)

NOA rec'd: 3/19/2009 (date 3/16/2009, priority 3/9/2009)

Biometrics rec'd 3/26/2009, appt 4/9/2009

IL: 5/22/09

ID: 07/06/2009

Oath: 07/16/2009

SSN updated: 7/16/2009 (not received yet)

Passport rec'd: 8/15/2009(nat. certif not rec'd yet)
