Thanks this is exactly why I didn't let myself get excited....even got another touch today.... wonder why they are taking so long for your case I'm so sorry. I know that you must want them to get things moving..... have you talked to your senator to call uscis and check on your case? Hang in there I am praying for you and everyone that is waiting.....The waiting to be with the one you love is something we all hate to have to go through....

I'm sorry you are having to go through this. I know how difficult it can be. I waited 18 months before my husband finally came and it felt like forever. Hopefully the will move your case quickly and you can put all this behind you.

Married: May 28th, 2007

Arrived in the US: December 10th, 2008

Thank You all so much.....but I just got off the phone with my senator's office and I told her what was going on and she checked with USCIS.....she told me that they are barley working on the 2004 cases like mine so this is my great future waiting years.....I don't know if I have it in me.....I wanted to move there but my kids do not want to live there and I can't blame them.....I don't know what to do....but thank you all so much

As I mentioned in a PM, returned cases are not given a priority date. The notice you receive in the beginning is due to the USCIS receiving your case back...as indicated in the email you received. You will get the same notice in hard copy via postal service soon. Touches which happen shortly after that are merely due to the file being passed on to the locations required for waiting for the review to actually happen. Many do not even get touches displayed on the online status at this point in the process.

The return process can take any where from 8 months to 2 years due to these returns not having a priority date. I have seen some cases take longer, but it is rare that it takes over 2 years. Many returned CR1s that I personally know of were reviewed around the 18th month and they were reunited before the 2 year mark. Again, nothing like this is guaranteed, many things can happen while waiting for a return to be reviewed such as changes in policy, or simply backlog that takes priority over any returned petition.

You do have time before they actually review your case, definitely time to go and visit your husband for a month. Just make sure someone regularly checks your mail for you in the event this expected letter or additional communications are sent to you.

Continue to gather documentation of your relationship and marriage during this time. Document this trip well so you can provide it and all additional evidence you accumulate during the waiting process when the NOIR/NOID comes to you. Be patient, stay strong, and follow up at least every 90 days until you get an NOIR/NOID. It would be helpful if your senator does the same at least every 90 days.

Have a safe and wonderful trip, focus on having fun together and possibly take a trip to somewhere special while you are there. :)
