I went to SSN office today since I just got my EAD last friday but then according to the lady my SSN number is not yet posted by the Immigration.We were so disappointed to hear when she said we need to wait 2 to 4 weeks. to wait for my SSN .So my husband has to call his accountant for extentions of filling on his taxes.Too sad when you need it this kind of time. ..

HOw true is this, i thought that SSA and DHS which EAD is issued from are separate, is it really immigration assign ssn?

Immigration is not issueing the SSN, but SSA checks your name and immigration status with DHS. It sounds like DHS isn't showing your EAD approved in their system yet. The SSA office can make a formal inquiry with DHS for the info, but that can take forever. I would try again in 2 weeks. You may be able to just call the 800# for SSA and ask if you are in the system. 1-800-772-1213

I suspect you were trying to get the SSN in your married name and it doesn't match your passport, correct? If you want it in your married name, you have to wait. Get it in your maiden name and you can do it today (or the day you stepped off the plane).

Your husband can file his taxes (but not electronically) by entering your SSN as "pending". He may or may not ever have to uodate it with IRS as the IRS links to the SS administration and it will update 2 weeks after getting your SSN.

I would go back to the SS office, appy in your maiden name, get your card and when you finish AOS go back and change the name, it is all free.

Yes he can file by writing explanation note for your pending SS# on a piece of paper.

When you don't have SS#, you guys can not get some credits like Education, EIC etc......

Yes, BUT he cannot file electronically. He will have to file a "paper return" and he CAN claim any credits, deductions, etc. you are both entitled to. If you were married before the end of 2008, you can claim anything you are legally entitled to. Attach a letter explaining if you want, probably not necessary.
