Hi,

I got married last 2006 and I petitioned my husband and his 14 year old daughter (from a separate marriage) for a green card. They both got conditional green cards. We recently filed an I-751 to remove his conditions for permanent residency 3 months prior to the green card's expiration. We didnt include his daughter in the I-751 since she got her green card 90 days after he got his. My husband's I-751 application was approved an he now has a 10-year green card. My stepdaughter, still has her conditional green card which will expire soon. I was reading the I-751 instructions and in Part 2. Basis For Petition Section, has the following choices:

a. My conditional residence is based on my marriage to a U.S. citizen or permanent resident,and we are filing this petition together.

b. I am a child who entered as a conditional permanent resident and I am unable to be included in a joint Petition to Remove the Conditions on

Residence (Form 1-751) filed by my parent(s).

It seems that based on this, she has to file the I-751 herself and check on option B in Part 2. Is that a correct assumption? If so, I have several questions:

1) Who will sign in Part 6. Signature of the form? When we filed the I-751 for my husband, he signed on the Signature box and I, the petitioner signed on the Spouse box. In my stepdaugher's case, will she sign in the signature box? Is this allowed when she was only 14 years old? If not, who's signature will this be?

2) USCIS mentioned submitting I-751, I-551 (the green card) and supporting evidence for the application. In my husband's case, we submitted evidence that our marriage is bona-fide like joint bank accounts, credit cards, utilities and house deed with both our names on it,etc. In my stepdaughter's case, what supporting evidence is INS looking for? Is it evidence of our marriage like the ones I submitted, or evidence that my stepdaughter lives with us?

3) I also read somewhere that when a child turns 14, she needs to submit an I-90 (Replacement of green card) and get biometrics. Is this applicable for conditional green cards too? She will turn 14 come March 2009 and her green card will expire next year. Should be file an I-90 for her now, and file an I-751 for her next year? Is an I-90 application applicable only for "PERMANENT" green cards or also for "CONDITIONAL" green cards?

Any information will be much appreciated..
