My wife and I submitted our AOS (form I-485) in September of last year. 1 month later we received an RFE because there was a missing page from her birth certificate. We sent it in and it was received on October 31st. Now, just last week (FEB 13th) we received another RFE claiming that our "Sponsor's income is sufficient, however, no evidence had been submitted as proof of income".

Both my sister and brother-in-law agreed to sponsor us and we did submit all the necessary proof of employment and income including pay stubs and letters of employment for the both of them. I was told by the person who helped us submit our paperwork to re-submit more recent proof of income again and that everything should be ok. I am hoping that they will except it this time.

Is this common if there is more than one sponsor and should we expect a long delay once we do re-submit it? Has anyone else received more than 1 RFE?

On the I-864's; were tax returns (and supporting documents) submitted? If assets were used, was there documentation of these assets?

Right and unless these people live in the same house as you and submit I-864a, they cannot both be sponsors. One of them must qualify alone based on their own income and/or separately owned assets.

Well I submitted my tax returns and I didn't make nearly enough. I didn't use any assets either. We did submit our sponsor's tax returns as well.

I did forget to mention that the RFE only asked us to submit our sponsors pay stubs for the previous 6 months (again) and a letter of employment stating wages earned and dates of employment (also, again).

It's not too difficult to do, but since it involves finances it does make me worry.

Which one is the joint sponsor. Did you submit separate affidavits and evidence for each?

The problem was that since they have 3 kids, she didn't make enough to cover the kids and us so we added her husband's income and provided the same documents as my sister's as well as the affidavit.

I just don't know why they would ask us to re-submit documents we already submitted.

That IS strange but you're not being clear. For a given immigrant, the petitioner and one joint sponsor are all that is allowed. It sounds like you you have multiple cases, at least three. That would require a minimum of three I-864 forms from you with supporting documentation and a minimum of three sets of I-864 and supporting documentation from joint sponsor(s). Did you send only one set of supporting documents? If so, that won't work because although the cases are likely to be dealt with together, each case file must stand on its own. Each intending immigrant has their own case file.

All documentation needs to be within one year, by law. The USCIS may, if they decide, request more recent information. I would send everything as recently as possible. Get new employment letters, submit new check stubs for the past 2 months (minimum), submit most recent tax returns with w2s (2008, it is the middle of February, I know they are "not ready". Get them ready and attach them) Each co=sponsor needs to submot exactly the same information you do. Each co-sponsor needs to count your spouse in their family size.

I guess my main question is whether it's common to receive more than 1 RFE? Also, once re-submitted, were the cases approved quickly or did it take a while?

It's not all THAT common - but it happens.

Processing typically resumes fairly quickly once the RFE is replied/responded to. :thumbs:

No, only one joint sponsor needs to count any given immigrant. They coun't their own household plus any immigrant's they are sponsoring. Sounds like one is joint sponsor for one immigrant (the spouse) and the other is joint sponsor for two (the kids).
