Hi everyone,

My brothers fiance K1 visa was denied at interview in Adis ababa, Ethiopia May 2008. The reason was mistake made on one the forum saying that she spoke Italian so she got an Italian interpreter :blink: and she doesn't no a word of Italian. Well this made them doubt the relationship I guess.

Its been a half a year since then and no action was taken the last one was take on August 18 ...

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status: This case has been received from the State Department with a request we review it.

He calls USCIS but nothing is moving along. What steps should he take now? should he refile the K1 visa?

1/10/2008- *touched* (if that means anything)

2/17/2008- Touched....(everyone once to be touched)

3/5/2008- NOA 2

3/7/2008- NVC recieved

3/9/2008- NVC send to US embassy in Ethiopia

3/14/2008- US embassy in Ethiopia will receive

3/30/2008- Packet 3

4/24/2008- Interview YAYAYAYAYAYAY!

4/29/2008- PICK UP VISA ALHAMDULLIAH! GOD IS GREAT

What does the US Embassy/Consulate say? (USCIS doesn't have the case any more - now in the hands of DOS/Dept.of State.) :thumbs:

The Consulate sent it back to USCIS for review. They DO have it

So USCIS has it again, that will mean you have to wait till they feel like working on it!. What a dumb as$h%^&ole#s. It will be like waiting for a NOA2 again i guess.

Keep calling USCIS and ask for a supervisor!.

03/13/08 - I filed for Citizenship

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

03/13/09 - We will fly to see Daddy Gary

03/16/09 - 1 PM Interview (Pray God he gets visa)

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

Well, technically, it hasn't been denied yet. Calling any government agency is usually a frustration. You WILL be sent another letter and follow what it says. My guess is it will require further explanation OR a re-file OR further evidence of relationship. Who, exactly, said she could speak Italian? Someone who thinks Addis Abbaba is in Sicily?

You could contact the immigration specialist in the office of the senior Senator from your State or your congressman for assistance.

Please be more clear in further explanations. You say your brother's visa was denied but they speak of a "her" having an interview. I take it your brother is a US Citizen, so "his visa" could not possibly be denied OR applied for. Citizen's don't need visas, foreigners do, so I take it your brother's fiancee's visa was denied. Where is your brother? He's the one who needs to be taking the lead in this matter.

If I was u I would get an immigration attourney. Make sure the consulate didn't declare it fraud. The fact that it has been returned is bad bad news for you. Because the chances of your petition given a final decision of denied has greatly greatly increased uscis dept of state rarely overturn an embassy's decision unless it is a major error on their part. You should of not waited till it was returned u should of done everything you could to fix the problem before it left the embassey that way you would have a good chance of clearing up the problem.

I would prepare for the worst and hope for the best.. If it is not been declared fraud then you can just start over again.

if they don't overturn the embassy's decision then you will get a NID notice of INtention to deny and that will be the final nail of the coffin for that petition .Problem is USCIS has no time limit on how long it can take to process this case it can take up to 2 years for them to reach their decision. I would consult a good immigration attourney if i were you on this. Good luck
