Hi,

I am filling out the forms as I am speaking for AOS for my wife. The I-864 form says that I must submit copies of tax return forms and W-2 for the most recent tax year.

The *most* recent year is of course 2008, but we all know it is not due until Apr 15, and I haven't got a chance to work on it yet.

Is it okay if I use 2007 as the most recent year? Or must I file the 2008 tax return as well?? Thanks.

P.S. My now-wife arrived the day after thanksgiving and we got married soon afterwards. Life has become quite hectic since then and I haven't been here at all... but still I would like to say thanks to everyone who has helped us, and a belated happy chinese new year.

Yes, the most recent tax year would still be 2007 as the filing date for 2008 hasn't been reached yet. If there is a long delay in processing your application, however, you may receive an RFE for the current tax year (2008) or if you have an interview you would bring those tax documents with you. If you were able to get the 2008 returns filed in time, then you would certainly want to use those, but 2007 should be fine filing at this time of year.

Last year some peeps that filed in January got RFEs for not filing the previous year. Best to file 2008.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

When Rin had her interview in April 2007, I had not yet filed for TY 2006. I had them completed, but needed Rin's signature and letter for treating her as a resident alien for tax purposes (since we were married in 2006). So I submitted TY 2003 to 2005 transcripts and a copy of the TY 2006 return clearly marked as a preliminary copy.

04/18/2007 - POE LAX - Finally in the USA!!!

04/19/2007 - WE ARE FINALLY HOME!!!

10/02/2007 - K-4 Interviews - approved

10/12/2007 - Everyone back to USA!

06/20/2008 - Mailed I-485, I-765 (plus I-130 for children)

06/27/2008 - NOA1 for I-485, I-765, and I-130s

07/16/2008 - Biometrics appointment

08/28/2008 - EAD cards received

11/20/2008 - AOS Interviews - approved
