Clarification Needed for CR1 Case in Mumbai

The flip is unsuccessful. They have asked us to report to the US consulate on Feb 25 if we want the CR1 visa. Non-negotiable! :angry:

what are you going to do with your k3 interview? Do you have to cancel it or you just dont appear for it?

07-23-2012: I-130 received by PHX lbx (forwarded to california)

This is a bit surprising. In another forum, pushbrk mentioned that if the consulate has I-130 case with them at the time of K-3 interview, they are not legally permitted to give K-3 visa and hence, must give CR-1 visa. Maybe you can open a new thread in CR1 forum with attn to pushbrk to ask for his assistance.

In your case, if nothing works out, its only 14 days which is worth the wait for CR1 visa. Did consulate tell you to even report to K-3 interview or reschedule it? What are you planning to do with your K-3 interview?

I know there have been threads regarding this but I can't seem to find them. I am searching now and was able to find one. I will continue to find more as I want to know more also.

In the above thread, someone mentioned that they may not switch the interview classification (which is what you requested) but at the time of the interview, if the consulate has CR1 case with them, they can grant CR1 visa. It depends on consular officer but usually they do it. The thread also mentioned that if K3 visa is received and if the consulate doesn't grant the CR1 at that time, the beneficiary can go back to sign DS-230 Part II during CR1 interview date and get the CR1 visa.

Need to do more research. I will let all know what I find. Also, if there are any updates on your side, please let us know.

this is what they said 'please ignore your k3 interview of Feb 11, 2009 and report to our office for your CR1 interview which is scheduled on Feb 25, 2009.' I am trying to figure out what to do now. this puts me in a bit of dilemma. i had already booked my ticket to India to be ready for the Feb 11 date. Now, I am gonna have seek clarification from them about this e-mail and see if we can still appear on Feb 11 for the K3 interview and at consular officer's discretion be given the CR1 visa.

Worst-case scenario:- We have come back again on Feb 25 for CR1.

Moment of truth tomorrow. My advice for flipping....if you are going to flip, don't ask Mumbai Consulate for the permission to flip the interviews. Just show up for your K3 and make sure that your CR1 case is also there. While on their premises for K3, tell them about CR1...they can't send you back and if they do...that's just your bad luck :)

Yes. I received a response from Mumbai Consulate. Apparently, they cancelled the K3 interview and kept the CR1 for the CR1 date. The flip was completely unsuccessful. The lesson learned: DO NOT E-MAIL THEM ASKING THEM FOR A FLIP. If your K3 and CR1 happens to be at the Consulate and K3 interview is scheduled before the CR1, simply show up for K3 interview and the chances of you getting CR1 are much higher.

This is not the first time I got smacked for being nice...anyways, two weeks is no biggie. :)
