Hello,

My fiance filed the K1 Visa back in July, last year. I got the letter for interview from the embassy in October. My fiance then set the interview date at the same month, but decided to cancel after a few weeks and move it to Dec. which he did. But then he wants to cancel it again and he did. And this year, 2009, he called the embassy again and set my interview for the 3rd time, and so I will have my upcoming interview in the 20th this month, but then again, he wants to cancel it again. It is not cancelled yet, but he is planning to cancel it soon since the last date for cancellation is in the 15th.

He was doing it for different problems and different reasons.

My question is, will this cancellation things, will most likely deny my visa?

Please let me hear your knowledge about it.

4 times he has cancelled.

Are they valid reasons in your opinion?

Is he trying to attend the Interview with you?

Hmmmm I cant think of a good reason to cancel 4 times but am sure he has his reasons :whistle:

K1 129 days to approval

K1 179 days to interview

EAD 45 days to approval

AP 45 days to approval

AOS 69 days to approval

Yeah. I think your fiance must have very good reasons for doing that. What might that be? I think you should be ready to disclose the reason for it just in case the consul asks later on (when the interview finally takes place).

07-09-09 - interview passt.. thanks to god and mamamary

07-19-09 - 2nd visit my fiancee philippines

07-26-09 - My flight to go USA together with my fiancee

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Is there something you haven't shared? The visa application and interview are yours and it is up to you to be changing the date. Yes, when and if the interview actually occurs, there needs to be a good explanation of these delays.

WOW 4 times..sorry BUT I would NOT be cancelling it again no matter the darn issue. Does he want you home?? why is he delaying it OVER AND OVER. I think this would be a HUGE red flag soon the more he keeps DOING it

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Thank you for all of your replies.

I am from Philippines and he is from US.

He told me all his reasons why he was cancelling those appointments and why he wants to cancel the 3rd one.

1. he said, he had find out (after scheduling my 1st interview) he couldnt file a tax return last year, said, he could only file it this month, january, so he have to cancel my 1st appoinment.

2. he said he was so busy with school that december since it was his final, and so he couldnt work with the other papers needed for my interview, like the evidence of our relationship

3. and third, why he's planning to cancel the january appointment, is because of my CENOMAR. He told me to order it right when it was Holidays, so now he thinks I could not get it earlier before my interview in the 20th.

Are the 3 reasons valid enough?

He was the one doing all the works on our visa, from the smallest to the biggest.

He only asked me to do things that I needed to do myself, like requesting my birth certificate and stuff...

If for the third time is the CENOMAR issue you can get a CENOMAR even tomorrow it is only 3 days you can still catch up for your interview on the 20th. Whereas for instance you go to your interview and have`nt bring your CENOMAR with you , you can still attend for your interview, USEM may just issue slip for you and you can go back to USEM to drop by your additional requirements. I have read some post`s here in VJ who attended interview even lack of requirements with that case....Good luck to both of you and God bless!

The I-797/NOA2 has a 4 month validity period. This date is often extended by the Embassy without issue but, whereas this is your choice/decision to keep cancelling, you will probably want to check with the Embassy to make absolutely sure this is not going to create an even greater problem than continued rescheduling.

As far as your fiance decision to keep cancelling.... only you can decide whether or not the reasons he gives you are valid. I would imagine the continued cancellations would add some scrutiny to your interview but it's hard to say until you get there.

If you are absolutely certain that this is what you and he wants, I would also suggest you go to the interview/cemonar even without all documentation. Everything will just be on hold until you supply what they ask for but at least you/he wont have to cancel again.
