It's not so clear to me that he entered with immigrant intent. How can you be so sure?

Firstly you Clearly show immigrant intent when you entered the country, USCIS can deport, and BAN for life if they suspect misuse of VWP for IMMIGRATE.

The safest route is to file an I-130 for a spousal visa and return home to interview for a proper immigrant visa and to NOT overstay the 90 days allowed by VWP.

You should definatly go to the doctor to get the immigration medical done and INCLUDE that in with your AOS. Trust me this will save you alot of time.

i agree with brian

if u send it without the medical u get an RFE and it needs longer to get the work permitt...u have already time enough to make the apointment and do the medical..u will get apointments really fast...but send all together!!!
