Hello all,

wanting some very basic advice, starting out on the immigration trail. I am infact the one coming to america (hoping) . My fiancee is american and i am english. We have met and have continued to communicate via phone, mail, email (everyday). We wish to marry and for me to relocate to USA. We have spoke about this at length and are both commited. Could someone please give me a list of hot to go, as comprehensive as possible and tips. Many thanks

The best advise that I can give you is to read the gudes it is a great place to start, also you have the example forms and letters which are a great help.

Start there and then if you get stuck ask any questions you need help with

I would suggest you search the threads, there are some very good and highly informative "pinned" items that can help guide you through the process. Personally, I found this site out of frustration over the waiting game! Just make sure you document your relationship, photos, phone bills, airline ticket stubs, hotel reservations, etc. This is very important!

i am due to visit her again in january, do i tell immigration that the purpose of my visit is to visit my fiancee? and if then she files for the K1? is this the start?

also sorry to be so naive but this is all daunting and confusing but what does 'touched' mean, when i read timelines

Dont lie to them but dont give up more information than you have to, I am going in December and I wont say visiting my fiance

When you get your NOA1 you will get your case number then you can register on the USCIS site for e-mail updates. When you go and check online and if the last date stated changes that is a touch, could just mean that they have moved your file.

wow been doing this for 4 hours now and finally understanding what i fear is 1% of what i need to know.LOL. But if she's worth it, then its worth it, and she is.

i will visit for 3 weeks only in Jan and say girlfriend, then after i leave she will submit I-129F. i think i have this right. I have collected and retained all letters, phone bills, etc for months now along with plane tickets. Any other items i may need (collective photos, statements etc)???

That's good that you have kept all those records you will need them for the interview but for submitting the petition all you need to do is to prove that you have met in the last 2 years we sent in copies of our e-tickets and copies of our passports, and for luck a few pics

I can understand. I have spent DAYS and DAYS reading information on-line.

You can file the I-129F whilst you are there, if you wish. In the meantime you could download a copy of the G325A - this is has to be sent with the petition and has to be an original copy. You could start getting that together, it's not difficult. Also USA size passport pictures - when your there. Just trying to help you save on the postage. :thumbs:

Keep any evidence you have have as proof that you have met in the last 2 years - boarding cards are useful too, so hold onto those. Keep everything. You will need it later on too.

wow, thanks to all for your help, but i do need to ask 1 more question, sorry but i want to get this clear in my head as i have read 2 conflicting statements. so here goes: If she applies for the fiance visa when i return home in january, and it goes through, i return to the usa and marry her within the 90 days, THEN AM I ABLE TO STAY WITH HER???? or do i still have to return home? I am basing this on the fact that you have to return after 90 days if not marrried so therfore when we are married we i can stay?

thanks in anticipation. basically i need to know , can i stay with her once married and change my status and continue the application together, she is able to provide for both of us as she earns good money (i read it needs to be 125% above poverty line). again any help please please please. thank you all and god bless you all.

Welcome to VJ and the start of your journey to getting a K1!

When you recieve your visa (the K1) you will have 6 months to use it. This means from the date of issue of your visa, you must enter the USA within 6 months.

Once you have arrived in America, you will have 90 says to marry your fiancee. You must do this before the 90 days is up or you are out of status and could get in trouble. After you have married, you are able to remain with her while you go through the Adjustment of Status Process. This process will lead you toward your 2 year green card and employment authorisation document (EAD)

If i were you, i'd get the whole process started as soon as you can....currently there is a heck of a wait, so if you are sure you want to be with your lovely fiancee...dont delay! We only got our petition in last week, and i expect to not join my david in America until at least july of next year....

09/05/2009 - Biometrics notice received

09/23/2009 - I-485 Transferred to CSC

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

Just to clarify, not only can you stay, you MUST stay until you get the green card or AP (permission to travel) or you will have to re-file for a spousal visa and wait another year. Once married on the K1 DON'T leave until you have one of the above 2 documents.

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08
