HI

Does anyone know what happens when a person gets married for the second time and never changed name from her ex husband last name. I have a 18 months baby with my actual husband but we dont share the same last name. I'm planning to visit my country with her and I would like to know if this okey. I try to call INS several times but their menu never leads me to a real person to talk to. I do have a permanent resident. please help.

First of all the INS does not exist anymore. Second of all, it is because the USCIS (formerly the INS two name changes ago) does not manage the boarder posts... You need to be talking to the CBP if you want information on what will happen upon return... Another question might be will you have problems exiting your home country?

Most of the time a notarized document from the father (named on the BC) giving permission for international travel is all that is needed.

When the parent and and baby don't have the same last name, it is customary to carry certified copy of the baby's birth certificate to show the traveling parent is indeed the child's parent. You may also need a notarized letter of permission from the other parent.
